Presumably the smart/fit/sober ones will be doing their best to avoid conscription and what we're seeing is mostly the slow drunk guys who got caught.
 
Is their any kind of international law about fighting what could be the most incompetent army? Like, unless the clearly surrender can ya just shoot away at them?

Look at Law Of Armed Conflict. In your scenario, no not really. The part of LOAC that applies here is Distinction. Regardless of capability/competency, armed uniformed forces invading a country are fair game. They would be clearly defined as combatants under international conventions. There are caveats, as long as they dont make any clear attempt to surrender, are clearly unable to fight due to injury (hors de combat), or are clearly marked as non combatant (Padre/medic etc). Then they are fair game.

It seems clear that most of these guys do not buy the Kremlin bs - though many would carry out there duty if there was indeed a nazi horde invading Russia.

In another country? Nope. Defending my country of birth or my country of residence against an invader? Yup, but they’d be utterly screwed if they needed my help.
