Chances of overturning driving ban?

Don't do anything to get pulled over then.

The car will still be taxed and insured, drive safe etc. Only real risk comes from another driver ploughing into you lol

I managed to get up to 6 points in a short period of time, I didn't do any speeding until those had disappeared. Getting 15 points just shows carelessness IMO.

Either way it's not like people who are banned are physically forced to stop driving - few trips here and there is no bother if necessary so don't let it fret you too much :)

Probably why the hit and run drivers leg it after running over kids and killing them in Birmingham

Considering 4 people have been killed in hit and runs including two children in that city this month due to people driving stupidly or too fast for the conditions etc. you're not wrong https://www.theguardian.com/uk-news...-four-cyclists-and-pedestrians-die-in-a-month

Yup, the 4 year old killed at the end of May was just a couple of miles away. The ******** **** had his own kids in the car and "couldn't let them see it" so drove them home safe and sound before handing himself in. Hopefully the scumbag suffers a nasty "accident"

I really wish I could say that she was a reckless driver and a speed freak, but she just isn't. I'm an anxious passenger at the best of times and I've never felt unsafe sat next to her. I do genuinely think that she's just got unlucky in areas down south especially. Not an excuses of course, she flat out is in the wrong and should pay more ******* attention, but to say she's a 'dangerous' driver with intent just isn't right.

"unlucky" sounds like she had no control over it. Perhaps a ban would be in everyone's interests if she's losing control of the car so often?

Not much trolling, he just doesn't like what was being said

Not particularly, I wouldn't have posted it there if I didn't expect the majority of responses to be (rightly or wrongly) unsympathetic. Was genuinely curious as to whether anyone else had been through something similar

I had my speed awareness course so long ago I have that option back now (I believe)

I have no idea how I haven't had more than just that! I drove my s2000 "excitedly"

I *THINK* "Driving furiously" is still on the statute books from the days of horse drawn carriages ;)

I'd take the points to have that on my licence :)

I can just imagine an unsympathetic magistrate saying, "Ms, I couldn't help but notice your subtle but erotic display of your divine feet, they really are a superb asset to you, you'll be using them a lot for a while, 12 months ban, next case please". :)

Seriously. though, good luck, it must be a worry and there but for the grace of God and all that...

Aha thanks. The max they can apply is a 6 month ban so at the very most she'll be driving again by Christmas (just about)...

I know someone similar to this who got 12 points and then got caught again. They went to court and pleaded hardship/need car for job so they gave him a further 3 points and £250 fine but importantly let him off without a ban. Unfortunately, with 15 points on his license he then got caught speeding again and they banned him for 12 months and a substantial fine (I can't remember exactly but sure it was around £1000).

If you read this - 6 months is a minimum not a maximum:

Yep, 6 months minimum for totting up.

The 6 months was the maximum sentence stated in the letter given the offences noted. I would like to think anything she has to say isn't likely to increase that on the day

She needs to make an exceptional hardship plea. The most effective pleas don’t focus on hardship for the driver as after all it’s supposed to be a punishment. Instead, they focus on hardship that would be caused to others as a result of the ban.

For example, if you have an elderly relative you need to drive to medical appointments and there’s no public transport available, that could be a good argument.

It’s also wise to be explain why public transport / taxis etc would not be an option.

For those who are mentioning pleading exceptional hardship and getting the ban reduced, as far as I’m aware that never happens. You either have a successful plea in which case you don’t get banned, or you aren’t successful in which case you’re banned for 6 months. It’s not something you can negotiate.

It’s worth mentioning that you can’t use the same plea twice, so if she gets caught again she’ll have a bit of a problem.

There are forums dedicated to helping people in these sorts of situations which will probably help you out more than people will on here. Fightback forums is one of them.

Appreciate your post, thank you.

We're working on it every evening and we are indeed pursuing EH. I think we have enough evidence to support it but I keep hearing that it's very much a mood of the day sort of thing and that nothing is guaranteed.
