3080 is really underperforming

Not sure why they flagged I do wonder if the temp one is because Im Watercooled so it picks up no fan RPM?

Monitor is freesync and I have vsync disabled in nvida 3d settings
I was thinking more along the lines of something is not making good contact and is overheating.

Install and open hwinfo and run a benchmark then post this part from the GPU section.

I'd remove the block and repaste the die, make sure you use plenty of paste on it not just a thin spread like you do on a CPU.

When I did my die I plastered it on and spread it out making sure the whole die was covered.

Also double check the thermal pad placement to make sure the correct ones are in the right places.

Yeah was thinking the same, I've had a few instances over the years of not getting the block perfectly flush with the components, it screws together ok and looks right - but it isn't from a contact/thermal perspective.

What paste do people reccomend I've always gone with Thermal griz kryonaut.

Yeah I have the same stuff on my 3090 and EK block, my full load GPU temp is around 47-48.

I sometimes find, if I've got the block on and it's not perfect, it often looks like it's a bit bent, it can be quite easy to do :)

most people forget the gpu hotspot. the main temp we all go by is an average of the many temp sensors on the gpu die/core. the hotspot is well the hottest part of the gpu die/core. as you can see that's your reason for gpu clock drops. without the gpu hotspot sensor you would never know that your gpu is just overheating and dropping clock to save itself. i know the feeling of draining your loop (PITA) but the repaste should help well and kryonaut is a beast of a thermal compound :)
