No, I mean the driver himself should've checked. Only 2 avenues he can go down really he didn't check which can bring up a manslaughter charge.

Could the people not just by a plane ticket and stay illegally then, if they can afford to pay their smugglers?
Is that the standard procedure these days - all drivers checking their truck before crossing? If so he's not got much excuse, either complicit in it or negligent.
I guess, given the fines in place for drivers who do take across migrants (whether unaware or not), they really ought to be checking each time. He's certainly got some questions to answer here.

But with stories like this https://www.theguardian.com/uk-news...r-migrant-stowaways-even-if-they-alert-police where the driver still got a £19,000 fine when he called the police after discovering them, I guess that doesn't help with enforcement.
I guess it works both ways... he could have checked before getting to the UK.
If you can get let off by claiming you didn't know etc.. then there is less incentive to check in the first place. Or indeed a potential exploit for people actually complicit in people smuggling to use if/when caught.
