6 Points, No insurance!

Slightly OT, my brother is facing loosing his licence for "dangerous driving" (long story) and also points for driving with no insurance. Even with all the points they could stack up, (aside from the fines) he is within the 2 year probation, so as soon as they issue him with them, he re-takes his test, points are wpied and he is on a clean slate. The law really is a strange thing.

Well I won't even start there for 2 more weeks, and its on a 9 month temp to perm contract. Would it look bad if i asked for that letter after a month of working there or so?

Its 6 miles from my home, all country roads though as its in the next town.

OT again, but i would take what we all say with a Pinch of salt.

It may be opinions and i dare say a chunk of some of it will be correct, however don't go getting down or telling yourself the worst, as it wont help!

My advice would to be to maybe get in touch with someone (maybe a solicitor) who knows their stuff (Any police officer friends or frends of friends?) and see what their advice is.

Thanks for your advice, I know what your saying, just like to know peoples opinions, I will be nervous untill its done, as i love driving, and did not knowingly commit an offence. It's my job i worry about most, its a good one in a car production factory.

I will contact a soliciter probably, but the officer said, if it were him he would just plead the case and hope as the cost is crazy, he thinks there is a reasonable chance i'll get 5 points, first offence etc.

might have to get your bike out then! if worse comes to worse, 6miles isnt a big ride, 40mins at most for a slow rider. i think that it is only this distance may not favour you in court?
 
a friend got caught in a similar trap after re-newing with the same company and having the DOC revoked on the new contract.... IIRC he got a 1 to 1.5k fine and no points after arguing the need for the car to commute

and i totally see the point of scewing the sentence if you need to drive, they are punishing you to a certain level - not totally screwing your life up, theres a big difference between getting one endocement, and thus having a higher chance of getting banned in the future and getting an instant ban and loseing your souce of income. Sure if its your 6th offence then its your own damn fault for not bucking up your ideas, but you can't ruin someones life cause of one mistake

and as for the "you put yourself in that position" arguement - not everyone can live in an area near to their work - its just not practical or fesable!

this makes me feel better, thats bloody high thought! Isnt it done on salary, as i currently being in 500 per month, but hopefully next month with the new job it will be 1650 per month. I live with my mother and a bike ride on a pitch black country road in the middle of winter doesnt thrill me.
 
Note that Dangerous (who drove for a living and thus required his licence for work absolutely rather than just getting to and from it) had his licence revoked even though his boss wrote a letter and whatnot.

"I need it for work" isnt always a given!

Bit of info from the Department Of Transport:

Driving a vehicle on a road or public place without insurance against third party risk is an offence contrary to Section 143 of the Road Traffic Act 1988. The requirement is for the driver to be insured in respect of the use of specified vehicles, rather than the vehicle to be insured for use by specified persons, and, following the recent Greenaway review of ways to tackle uninsured driving, it is not proposed to change this. The driver may be insured to use one or more specified vehicles only or to use any vehicle with the consent of the owner.

The penalties available on prosecution for the offence are a fine, up to a maximum of £5,000, the automatic endorsement of an offender's licence with 6-8 penalty points and, at the court's discretion, disqualification. On 1 June 2003 driving uninsured became an offence for which, instead of prosecution, a fixed penalty could be offered. The level of the fixed penalty was set at £200 plus 6 penalty points (the Fixed Penalty (Amendment) Order 2003, S12003 No 1254).

For drivers still within the 2-year probationary period prescribed by the Road Traffic (New Drivers) Act 1995, a conviction, or fixed penalty notice for driving without insurance leads in addition to a probable fine, to the revocation of their driving licence and the necessity to retake a driving test.

Find that a bit confusing, so does that mean i could get away with less than 6 points + fine? and keep my licence?

I was mainly refering to the good luck in court bit mate that i appreciated, Nice to hear good comments when i'm feeling down, rather than abuse. Cheers mate.

With regards to the scooter, its something I'd think about, that or sleeping round my dads, even though i can't really stand him. As he lives about 2 miles away.
 
Always have a back up plan :D .. try play the courts.. but if they take ya licence (harsh if they do) then at least you will have the income to get your test done again etc with the new job :)
 
A mate of mine got done for the same thing, lost his lisence. Also with the endorsement on it, his insurance quotes are now monumental. Sorry to be the bearer of bad news.
