There is also another part of the steward hearing report which states they accepted Masi's reasoning for only allowing some cars by as only the lead cars matter, yet Sainz in 3rd still had a lapped car between him and Max in second, so apparently 3rd isnt a lead car in Masi's eyes. CAS might disagree with that one as well.
The FIA are going to have to explain the inconsistencies, and also why Masi decided no lapped cars passing to suddenly lapped cars passing, and as well as what you pointed out why previous processes were not followed.
Would CAS accept "for the entertainment" as a reason?

Exactly what about the cars that were not allowed to unlap themselves. You had championship points and constructors points at stake as well.
The evidence all points to the fact that everything was done to allow max to win.
Don't get me wrong if it happened 10 laps previous and Max had won the race it would have been accepted although annoying but the rules would have been followed and adhered too. The evidence here simply shows it has been hell bent to give him the championship.

and that is where i think Merc have a good chance in court. The fact that only the cars between Lewis and Max were allowed to go through, and then the race was rushed to restart immediately (not the following lap) after that speaks of nothing but total bias against Lewis.

The intention of a rule can't be to just let Masi make up any old ****. What if Masi said Lewis had to give up his position to Max before the restart? If the race director can just completely fabricate any old arbitrary rule to do with the safety car, that is obviously not the intention of the rules for a sporting competition.

thats what i basically said earlier.. the FIA restarted far to early, it was NOT "Safe" to do so, and against their own rule

I dont like results been decided after the fact, my interest at this point is for the FIA to be bruised and Masi to lose his job.
Can't see it being overturned, if the rules are ambiguous and the race director has the authority under SC and he decided to restart the race as quickly as possible then it's up to him how he goes about it.
How was it not "safe"? Were there still marshals on the track?
If Masi quits does he he have to show up at CAS?

I suspect he will quietly "step down" once the appeal is over, regardless of the result.I hate when people have to go, but I think he has no choice.
