Another accident

No need to be aggressive, just phone her up or go round and ask why shes changed her mind and lieing now. It's easy enough lieing to someone who doesn't know what happened, but I bet you she won't even consider lieing to your face as you know the truth.

Think how easy it is to fob someone off in writing via a letter compared with in person and face to face.

The keyring cam was in jest, I'd be tempted but I recon a friendly visit or personal phone call might make things a lot harder for her.l

So she originally said to you (and the police?) that she did not see you when pulling out.

Now she is saying you were speeding...? How does she know this? She didn't see you!

If you were speeding them your cars would have ended up in a different place.
3 point turn after pulling out of her drive, what rubbish.

Remember this is a woman, and a rather stupid sounding one at that.

She could have come off the drive, turned one way then realised she actually wanted to go the other way :p

The pictures CLEARLY show that she drove into him, an expert analysis will confirm this beyond reasonable doubt.

If you'd gone into her at any kinda speed whatsoever that nicely unscathed front left wheel arch on her car would be a crumpled mess and if you'd been doing any kinda speed that would have required heavy braking and she had hit you, you'd have been up on the pavement.

Her claim that he was speeding is only her word against his and unsubstantiated.

On top of this you had right of way, she has nothing to prove you were speeding.

Keep the pressure on.

There is snow on her bonnet still - if she was doing a genuine 3-point turn out side of her house then she more than likely would have been driving the car for some time and the snow would have melted from a warm engine.

Hope the lying front-bum gets pulled up on this.:mad::mad:

her argument is that the path was clear and you were driving like a lunatic and thus didnt leave yourself with enough room to brake when met with somebody performing a legal manoeuvre in the middle of the road.

Seriously, if she is prepared to lie this much, her insurance co will send a solicitor that backs up and argues these lies as well.

Its gonna go 50/50 :/

Like this you mean

read from the OP then skip to this bit.

despite Blatently being at fault, the court still ruled in the other parties favour ! If they are prepared to lie this much, your going to be in for a VERY long haul.

That case was lost because the defence turned up with doctored evidence and the claimants party turned up without any evidence, as long as OP doesn't fall into that trap it shouldn't matter

I was in a similar situation a few years ago, a guy pulled out of junction just as i was passing and hit the passenger side of my car at the rear wheel. I braked and swerved when i saw him pulling out so he didnt make too much of a mess. He admitted fault at the scene.

When i got home his dad phoned me up and said i had rammed his son while he was sat waiting to pull out. Apparently i had come over a level crossing, turned a sharp corner and some how smashed mthe rear portion of my car into the front left corner of his car. All this he deducted because he said his son had told him and hes not a liar.

I told him to kindly ×××× off and my insurance company delt with it.

People come up with stupid lies, when they could just say.. yeah sorry it was a mistake, thats what insurance is for.

What was the outcome of this then? Did you win?

and record the conversation...

you could start by suggesting the insurance company have made a mistake and got her story confused with another persons...

my point being was that the Rotty supposedly had a top barrister from his insurance co. Ho hum !

you make it sound so easy, but unless you organize your own legal representation, you get what your given and are likely to find a similar result.

Yes i won, he pulled out of a junction and hit me, apparently its like rear ending someone, your at fault if you pull out and hit someone.

It didnt take long, about 1 week for the solicitors to sort it out.

Had one in feb, a woman drove into my car on the company carpark. When i phoned my insurance they said because its a clear cut case, they just transfered it all over to drive assist, who sorted out repairs and chased her insurance. ( im with esure )

the difference with yours was the rear end damage, when the damage is on the side its a totally different ballgame.

Another update:
I have resent the pictures I took to my insurer as they did not receive them when i first sent then. But they have records of me stating that I took pictures when I called them and informed them of the claim, should the 3rd party question them (I still have the pictures on my old phone too). He stated from the damage of the cars, the pictures and the fact that she was doing a "3 point turn" outside her house which was a huge driveway.. My claim is more than hopeful and the pictures further strengthen my case. The insurance company have forwarded the pictures to the solicitors dealing with the case. So fingers crossed

Good luck man. It's people that continue to fight a case when they're clearly at fault that helps put our insurance premiums up more.

Having a crash is one thing, but wasting solicitors' and claims investigators' time is a very expensive business. :/
