Apple vs Samsung, court orders Samsung to show Apple 5 new phones

As Robbo said, Apple could go after lots of others too but its Samsung that are most likely to dent their success so they are feeling it at the moment.

It was banned for this according to the Judge:

Dusseldorf regional court judge Johanna Brueckner-Hoffmann said that the "minimalist, modern form" of the two products gave a "clear impression of similarity".

You could argue that all tablets fit into that.
 
There will be more specifics that that. They have lost other cases due to lack of any detail in patents and just a general look.
 
There must be a far more specific reason than a "clear impression of similarity". We may not be privy to such information though.

As we mentioned earlier, the fact they had a finished working model ready for launch .. then the iPad 2 launched, so Samsung delayed and out of nowhere they had a tablet which looks and feels a lot like an iPad probably contributed.

Otherwise what was the delay and rapid design change all about?

Yes and what where these patents.
There is far more to a court case than one quote from a media article.

It's not just a case of a screen with a bezel, like you seem to think.
 
So according to the German Judge only Apple can sell thin, rectangular flat screens with round edges?
The original 10.1 still falls foul of this ruling... (same shape, just different back/thinner?)
Or was it the picture gallery issue too?

Again for me its simple
Apple are saying "Look guys, you had a design .. you pulled it last second, you released a new one which looks just like ours.. whats that all about?"

and by 'looks like ours' its the materials used, the new shape etc.

As Robbo mentioned, they got away with it (for now..) with the Galaxy compared to the 3GS. Its in Apples best interests to fight this now rather then 12 months down the line.

The gallery thing is a non issue.

Of course there is more too it, but the language from the Judge is worrying.

Maybe the judge is just thinking something along the lines of -

  1. Nobody had a tablet
  2. Apple revolutionised the tablet
  3. Other companies all swarmed to make a tablet with similarities to Apple's tablet
  4. Etc.
Who knows with these judges... :o

Maybe the judge has a suitcase full of Apple shares, sorry iPads. ;)
 
As far as i can see, it would be like a manufacturer patenting a flat screen tv, with a plastic surround, a power button on the front and standby light.

It would cover every flat tv which is currently on the market.

How can Apple patent something SO general and then cry when someone elses design resembles it.

I might just patent a driveable object with 4 wheels and doors and an engine and sue every car manufacturer in the world for OMG PATENT INFRINGEMENT. BTW I WELCOME COMPETITION BUT I WISH THEY CAME UP WITH THEIR OWN INNOVATIONS INSTEAD OF JUST STEALING MY IDEAS!11!1!!
 
Except apple has lost other cases with such general notions. So I don't think this is anywhere near this easy.

The judge also said that why the patents stand he doesn't have much say on it.

But samsung and another company have already mounted a challenge to over turn the patents.

The other interesting thing, is if the ban gets over turned at any point, apple have to pays compensation.
