That's not the case.
If it was they could get every smart phone and tablets banned.
Would be interested to see exactly what points the tab was banned for.
Dusseldorf regional court judge Johanna Brueckner-Hoffmann said that the "minimalist, modern form" of the two products gave a "clear impression of similarity".
There will be more specifics that that. They have lost other cases due to lack of any detail in patents and just a general look.

Be interesting to see how they deal with the lawsuits Google chuck at them once iOS 5 is released. Hopefully we'll see the iPhone 5 banned until Apple rectify it.
They say several patents have been infringed but the Judge upheld the ban as he/she clearly believes that its a copy.
Are you referring to the Notification Center?
Yes and what where these patents.
There is far more to a court case than one quote from a media article.
It's not just a case of a screen with a bezel, like you seem to think.
Of course there is more too it, but the language from the Judge is worrying.
Maybe the judge is just thinking something along the lines of -
Who knows with these judges...
- Nobody had a tablet
- Apple revolutionised the tablet
- Other companies all swarmed to make a tablet with similarities to Apple's tablet
- Etc.
Maybe the judge has a suitcase full of Apple shares, sorry iPads.
How can Apple patent something SO general and then cry when someone elses design resembles it.
