Apple vs Samsung, court orders Samsung to show Apple 5 new phones

Good to see some common sense from our courts.

+1 Absolutely. The American Court system should take a leaf out of the UK courts and follow suit!

I'm glad that (fingers crossed) we can buy what we want and not have tech banned.

The sooner Apple realises that they need to up their game and not throttle competition the better. Apple need to stop wasting money in courts and put invest in R+D and produce better products!

It not about making better products, their product are perfectly fine.

The issue is with them trying to get sales of other products halted claiming people might buy competing products by accident even when they look nothing alike and even a blind man couldn't get them mixed up.

Glad the Judge has had some sense in this instance.

Its interesting to see comments from Apple rattling on about protecting their IP from rivals and this judge to state (with proof) that their design has no originality...

So why did they ever get a patent granted for it ?
Stupid. In any case I guess its pretty much worthless now.

At least the UK/European side of things seem to have a better grasp of common sense.

How can you patent inductive charging FFS. Apple didn't invent it. Next they will patent charging by means of a plug and cable

They also patented "scrolling lists"!

It's as if the people in Apple see what is there, realise how integral the features are to smartphone use and just fire in patent claims irrespective of whether they actually have a legitimate case and the fools in the US patent office grant them.

The US patent office needs taken to task on their stupidity. I would also like individuals at the USPO financial affairs looked at TBH (cynical much? :p)

Apple = American homegrown company and massive source of tax to us treasury. Could be oversimplifying but not really surprising they are getting looked after in the corrupt us courts.
Thankfully the rest of the world don't really have a vested interest in Apples desired monopoly / unwillingness to actually compete on its own strengths.

I have had a brief look at the list of patents here - http://www.freepatentsonline.com/8223134.html

I am leaving for work in a sec so not had much chance to see them all however I thought I would put this individual patent and its abstract to see what people thought -

http://www.freepatentsonline.com/y2007/0205990.html

A mobile handset having a keypad with keys having three states is provided. The handset includes a plurality of keys provided in a first state, the keys having alphanumeric character disposed thereon; a touch-sensitive component operable to detect a second state when one of the keys has been touched; a press detection component operable to detect a third state when one of the keys has been pressed; a display; and a graphical user interface (GUI) displayable on the display, such that when the keys are in the first state the GUI is accessible for text entry, and such that when one of the keys is in the second state the GUI displays all the alphanumeric characters associated with the one key in the second state, and such that when one of the keys is in the third state the GUI displays the alphanumeric character selected by pressing the one key.

Now is this not how all touch keypads for all smartphones work i.e they have more than one output (letter, number, symbol) and these are chosen dependant on what "state" they are in which is enacted by pressing them in a certain way e.g. tapping, pressing and holding, using a "shift" key etc.

Perhaps I am reading it wrong but WTF?!?

Yeah they just changed whatever it was they were infringing on. Why they didn't just do this in the first place I don't know!

Because they didn't know they were infringing? Apple own a ridiculous number of patents. Some are very broad, others less so. In addition, there are millions of other patents which may or may not apply to any specific product.

Apple have patent lawyers who will literally rip apart a competitors product to see if it contravenes one of their patents, but in contrast it is entirely plausible that a company (even as large as Samsung or Google) could get a product to market without knowing if it fell foul of a competitors "innovation" or whether the relevant patent would even stand up in court.

Lol. Well their new US patents aren't going to affect us with our more sensible laws. Pretty much all of the functions in those patents already existed on mobiles before Apple even dreamed of a mobile.

And I doubt they will bother trying to use them, as I imagine Nokia will have something to say.

Last time Apple took on Nokia they lost over 400m plus were forced to pay future royalties.
