Apple vs Samsung, court orders Samsung to show Apple 5 new phones

The comments are amusing at the bottom. You have the probable Apple fans shouting about how Google is being a hypocrite as Google apparently stated that they would only use their patents to defend themselves and not use them to attack.

They also go on to say that, "why is Apple crippling innovation by filing these lawsuits yet Google is not and good on Google"...

no one even knows what the damn patent infringement filing is yet!


I cannot wait till next week TBH (Apple/Samsung case). Getting boring and tiresome now

As per a report in Bloomberg, Motorola Mobility claims Apple's products infringe seven of its patents on features including location reminders, e-mail notification and phone/ video players. Motorola has filed a complaint at the United States International Trade Commission seeking a ban on US imports of devices including the iPhone, iPad and Apple computers. Since Apple products are made in China, US sales are technically imports from China.

Not really, its been tried before and the judge ruled Apple only infringed on one patent, and its a FRAND so the chances of Google getting an import ban are between 0 and nill.

Ontop, Google are in a bit of trouble because some of the patents being used were purchased with a promise to the powers that be in the US that they would only be used to defend themselves, not attack other companies.. Google agreed, and then chose to start litigation anyway. Oops.

As i said, its a bit more serious then "google promised!' .. they could get into quite a bit of bother.
 
I find it quite funny, companys are now using Apple's methods of patenting everything under the sun and get by with barely a whisper of criticism. But as soon as apple patent something its, "who the hell do they think they are!"

I'm an android user through and through but its strikes me of hypocrisy

The whole patent system needs to be picked up and shaked up massively. It's absolutely stupid.

Reading the court cases is infuriating. Patents don't infringe because the code is unique but the end process is the same, or patents do not infringe because our system also works on diagnols and that one does not.....

Slide to unlock is patented, I mean REALLY?! It's absolutely stupid. Software should not be awarded design patents, ever.

Big corporates need a kick in the ass, part of this should be nullifying their stupid patents and forcing them to profit from real development and real innovation - Not patent settlements and licensing of stuff that should never of been patented in the first place.

If Apple wins, then doesnt that mean they basically have the right to a monopoly?

No as it only affects old phons. Sgs3 woud be unaffected.

Same if Motorola won. It Wouldn't affect the new iPad or 4gs. Have to wait for details, but android based phone patents have been dominated bray FRAND so far, meaning th can't withhold it from apple. Where apple contains "proper" patents that can be withheld. If they don't get overturned in court.

So theyi're all fighting legacy stuff. Which seems pointless, but I suppose these claims were made a long time ago and just takes ages to get to court.

If Apple wins the case,it only proves how screwed up the US patent system is and how biased they and the courts are towards US companies. I expect Apple to win,just because Samsung is Korean and the people in the jury probably would have no real intention of helping out a non-US company.

Reading comments on blog sites and such I have learnt that americans are incredibly racist, reading things from poeple complaining that Asus made the N7 instead of an 'American' Company, how all none american companies suck, how everyone outside of US sucks blah blah blah. Its amazing how much hate I've read, and things I never thought what mattered. I don't care where a company is based as long as their products are good, but to many americans it seems that being made buy a american company (however mostly built in china) is a big factor in buying products.

For this case I could also see it going the way Google vs Orcale went. Just hope this patent non-sense could be put to rest.

But if they did win here, then they could go on suein' a lot of other android OEM's which is clearly Apple's end game, take down the biggest OEM (Samsung) and the rest will fall. The amount I doubt will hurt Samsung, but others might feel the pain more, companies like HTC who are already having to fight so hard to secure parts (Just look at the S4 in the one S), and new OEMs being scared off which is Googles big plan, to let anyone who wants to build something based on android.

I wonder how long until governments get involved in it?? After all Korea and the US do trade a lot and I wonder if US trade protectionism is really something they can get away with,in this day and age.
 
I think every big player not based in the US should pull out of the US and let them have Apple and only Apple products.

Then the customer can vote with their feet when the US has no choice in the mobile market.
 
Apple will win, no question. Not because they are correct, on the contrary Samsung have the far more valid arguments, but because as it has been stated the American jury will simply vote for the American company, sad but true.

I expect so, even if its to their own detriment. Its not like Apple does them any favours.
 
The korean ruling is a complete joke, check Fosspatents for the reason why but basically Korea change/make laws/rules for the benefit of Samsung.

Why? because Samsung's mobile department is over 20% of S. Korea's GDP and they employ something like 40% of the countries workforce.

To expand on the ruling - the 2 patents Apple 'infringes' are Standards essential, but Korea have decided they no longer wish to recognise the FRAND nature and have allowed Samsung to charge Apple whatever they see fit, or Apple will be banned from selling their products (iPhone 4, iPhone 4s, iPad 2).
Samsung infringes on one non essential patent, allowing them to software patch it and get around without problems.

And people here are bemoaning the fact Apple are 'bound to win, its the US!'

Should add, not the first time - similar has happened involving LG being given obscene preferential treatment in their own country and resulted in various companies such as Toshiba pulling out of the country all together.

This shouldn't be allowed IMHO.

Ban the products - Fine, until a settlement is reached under FRAND for reasonable licensing terms and then lift the ban....


It should be an interesting next few days with all these trials coming to conclusions

FRAND doesn't necessarily mean anything.

Where is it enshrined in law?

It's been used in Germany that i've seen. Netherlands take a different approach in that the patent holder can sue for FRAND patents but the defendant can then apply to the court for a license.

The UK then takes yet another approach.

I do feel the closing arguments were a little too broad. They shouldn't have been allowed to mention the effects on the patent system and all this "American Dream" rubbish. It's trying to affect the outcome based on issues not related to the case.

Verge live stream last night touched on some interesting points regarding the case. They really do have to decide on many many points. Samsung are bound to fall foul on some points on some of the handsets in question, I wonder how badly many websites will twist the outcomes to make it look 10 times worse than it is.
