Yes, clearly all the governments and lawyers of the world have never thought of this possibility. They obviously know less then a bunch of random people ranting on OCUK that have probably never read a word of patent law.

What about Blackberry and Microsoft?
Take blackberry for what? Their phones are massively different.
Microsoft license a number of their patents.
Blackberry tablets have pinch and tap to zoom functionality.
Maybe it's programmed differently.
Another interesting a reticle. About rim and the situation in general. Saying rim didn't do rubber banding due to the patent, so it would be a bit odd if they did pinch to zoom knowing it would break the patent.

Talking purely from a hardware prespective:
Wired how Apple has steamed ahead with the iPad and andriod is playing catch-up. But with the information being leaked out about the Iphone5 is looks like for the second year running Apple's phones are the ones playing catch-up.
True, but the S3 has been released months ago, and the iPhone5 will not beat it. it will still have a lower res screen for a start! The S4 will probably come out Q2 next year and God knows what will be in that one!!
Most people couldn't careless about the hardware though. They want something that what they want, when they want, easily, and quickly. Apple products do that very well. Of course anyone on these boards knows that software is only part of that, and you need decent hardware to drive it, but non-techy types haven't a clue.
Premium product. I don't care about the gubbins inside it. It does it's job well.
