Call me an idiot but if memes are not banned which it seems is possible then what content are we talking about, images GIFs, video etc?

GIFs aren't banned either..

That was the original scare mongering

Now that isn't happening people have moved the goalposts and think that a mega corporation like Google who own YouTube (who already have sophisticated content filtering systems) will just cut themselves off from the entirety of Europe, rather than use their vast resources to come up with even better filtering systems.

I'm not saying it's a good law, I'm saying the hyperbole isn't justified.
 
Yeh but give me an example of copyrighted content, does it include music also.

What images, for example I posted a 'looney tunes - that's all right folks' image on the Trump thread, is that the kind of thing we are talking about. I watch a fair bit of YT but I can't think of much copyrighted material that comes to mind. They already have filters for music....

That is what Youtube have already said is an option - it's not "hyperbole", it's a real option, a worst case option of course but a real option none the less.

"Now YouTube has spoken out in perhaps the most passionate comments from the tech industry yet.

The company said that YouTube could be forced to stop allowing normal users to upload videos, instead concentrating them in the hands of a small number of big companies. Viewers in the EU could be blocked from viewing some videos and small creators could be ruined, the company said."

and a Direct quote from the CEO of Youtube Susan Wojcicki -

"The proposal could force platforms, like YouTube, to allow only content from a small number of large companies," she wrote. "It would be too risky for platforms to host content from smaller original content creators, because the platforms would now be directly liable for that content."
 
As if YouTube et al are going to willingly cut themselves off from 500 million people.

Probably less than half of that will actually use youtube and it might be cheaper than dealing with constant legal cases.

But Youtube/Google could simply move services outside of Europe. Then they are outside of the EU's grubby reach. We would still be able to use it, there just wouldn't be any "official" presence inside the EU.

And does that include ones which make use of 3rd party images? I'm guessing it doesn't say...

OFC they can't ban "memes" as a subject, but they can ban the images used in the meme. Nice spin though.
i think that's the problem with this, it's too "open" to actually be definitive of anything.

it sounds like it gives power to take down anything if they see fit.

This will likely be covered under parody.

The issue is the impact of the laws, that they still allow memes in theory doesn’t mean memes won’t be impacted.

As dowie points out, memes will be impacted because YT (for example) will have to use an algorithm to check every single video and an algorithm can not decide what is parody or transformative use - like a meme - it can only say "there is copyrighted material here" so even though the EU says "memes aren't subject to Art 13", the companies algorithm will be the instrument that bans memes instead, which shows that dowie is correct, the "impact" of the law will have more effect than the law intends.
