He had masses of pace, and could have chosen his moment at any time. Hell, he'd have stayed ahead just by hanging a little wide and keeping his foot in.
It would hardly be the first time similar punishments have been dished out - there's often a 'benefit of the doubt' if you like, given to the car that has gotten in front with these sort of calls - there very much is an expectation that the car behind will take action to not hit the car that is passing/has passed them.
