Bought this phone on eBay, does this look like "brand new condition not a scratch on the phone…" to you?

Dialup needs to upgrade to broadband / fibre.

In all seriousness though, I would interpret a 2 y/o phone listed "brand new" as being "new other" or "opened but unused", otherwise "used - mint condition". The photos from @Dialup aren't any of these descriptions, so I would file an item-not-as-described case with eBay.
 
I bought some "brand new" VR controllers, £250, from Ebay a couple of years ago. They were in excellent cosmetic condition but had been used, the packaging had been ripped etc. Plus I found out within a couple of weeks they had a minor fault. Tbh I just left it, I'd never returned anything before to Ebay.

Sold them on, disclosing the fault, at a loss. Kicking myself that I did that. I've since bought another item, £300, that had a fault, returned it for a refund but had a right battle with the seller in doing so.
 
No scratches, scuffs or blemishes, kept in a case, never dropped etc etc.

It's not hard to look after something.
Same as my old Nokia 6.1 and my wifes old Xioami 10T Lite. Both kept in flip cases and had screen protectors since they were taken out of the boxes. They were both retired at Christmas as we upgraded to Google Pixel 7a's and when boxing the old phones back up there wasn't a single mark on them. It really isn't difficult to look after things.

It really isn’t that hard.

Get a screen protector, get a case, clean the device occasionally and it’ll be 99% brand new.

I had a MacBook Pro from 2013 that in 2020 still looked brand new because I was careful with it.

People pretend it’s hard when it really isn’t. I always consider that I might end up selling the thing so I want to maximise my odds of getting a good price for it.

Me i buy a new phone every 4 or so years and the state it ends up in is completely unimportant to me.
Its a tool. As long as i can read the screen and it charges that's fine.
That isn't to say i drop kick it around and boil it, but i don't go out of my way to keep it pristine.

Return for a refund.

If it's listed as new, then that means new!

Same thing happened to me (worse actually) when I bought my daughter an iphone. Company listed as A+ mint, Hotukdeals all said fantastic seller who could be trusted. Phone arrived, and I've never seen a phone in such poor condition. Looked like it has been dragged across a concrete floor! Ended up buying a new one in the end.
 
The one's which annoys me the most, title says BNIB and description says opened to check everything works.
I've seen ones where people have put "Bought, but never used" in the description so when I ask if they bought it from a shop or Ebay they usually reply with "yeah it was from Ebay a few months ago but I've never used it". How I understand that is 'yeah you might not have used it but the previous owners sure did and you're trying it on!'

Mine ends up a state too.
I know my phones will get wet, scratches etc.
I don't like screen protectors.

I tend to keep them until they break anyway so no need to worry about resale for mine.

They are all. Bought second hand due to this as well. If it's gonna get scratched.. May as well by second hand.
 
it is why I like buying from places like here or a forums classifieds (basically anywhere with a bit of a community) if anything most of the things I buy then are better than expected (hell I bought a mobo and processor from here and the seller said " I found a 120gb SSD and thought you may like it so chucked it in".
 
Your first mistake was buying a phone on eBay you are infact lucky because its a phone and not a brick

Sadly, these kind of practices is the norm, not just on eBay. Take MPB, a popular used camera website.

Like New”, it had...

No box.
No Strap.
No triangle thing where the strap attach to.
Wear at the base, weird residue markings.

Stock photo. No actual photos of the item. Avoid. Especially for that amount of money.
