Busted . .

I leave my phone on passenger seat or center console, then if I get a call I just put it on speaker.

Strictly speaking I think that is illegal, but I'm far less likely to get caught, or cause an accident.

I think the policeman was a little harsh in this case. Imo most people would have answered the phone in stationary traffic. A warning would have sufficed.

Far more dangerous things on the road, as mentioned old people that simply are not fit to drive.
 
Ridiculous charge, in my opinion. You were not creating a danger by using your mobile phone.

Shall we next make talking to passengers, while picking your nose, illegal? This isn't exactly the pinnacle of human exertion here people.

Errr, Ive just looked that the Fixed Penalty notice, my name is wrong, my DOB is wrong and the transmission is wrong, probably just being silly, but that is funny!

OMG go and watch mythbusters. The reason the person next to you doesn't cause the same danger as talking on the phone is because they shut up when they see you are in trouble ro when traffic is getting heavy and let you concentrate while the person has no clue what is going on and keeps chatting anyway. Mythbusters did it and proved talking on the phone is more dangerous that having two large glasses of wine, IIRC, or something like that

Ive never been in a situation when I have needed someone else to stop talking. I really dont need to concentrate its all second nature.

Did mythbusters do this comparison whilst sitting still in traffric? NO.

What did they do? An obstacle course, with hazards and parking.

Hardly the same is it?

Don't come in saying OMG mythbusters proved so and so when in this actual incident it was irrelevant.

The OP can have some sympathy from me - sitting still/in slow traffic in a car answering a phone shouldn't be 3 point material in my opinion.

I thought you had to tell them straight away..? Otherwise if he has a crash, the insurance people would say he wasn't insured as having 3 points? (I don't know this, its a question more than a statement :))

Some insurers will want to know during the terms. Many don't, but it'd be a pain to get caught out by one that does!
 
Not always, they're more interested in not victimising people, I dont see this as victimisation... just law enforcement which they are paid and trained to do.

I bet they are paid and trained to taser people to death/close to death as well.
 
Simple answer is, get a hands free kit, no call is important enough for you to take such a risk.

Do people like you ever go outside the house or do you just sit there wrapped in tin foil & cotton wool ?

No sympathy here at all.

Why do people need to answer the phone at all whilst driving, how many calls are that urgent that they can't wait a few mins until you can pull over somewhere safe and call back ?
 
Doesn't matter, still illegal, your not giving full attention, its as simple as that and thats how the copper saw it.

I will admit too that if I got caught doing it I would take it on the chin... not matter how 'trivial' it may seem being sat at a standstill with my handbrake on.

Can you please stop speeding, illegally downloading stuff, watching things not meant for public broadcast etc etc.

I hate the holier than thou attitude.

A law is a law, they introduce it to blanket ban, so you cant use at all in a vehicle, doesn't matter if you are using at the lights or doing 70 on the motorway.

Friday I was behind a transit van coming onto the M6 and he got on I was behind him and he nearly hit a car towing a caravan and he swerved into the 2nd land, yes he was using a mobile phone.
