He wouldn't be unlucky, as that would be illegal, they have to supply equal, or better performance, they can't supply worse, so he can kick up a fuss, and they'd probably give him a much better card to keep him quiet.

My dad's MSI 7900GTO popped a couple of weeks ago so he RMA'd it and they've sent him a 256mb 8600GT in its place. He's still in the process of sorting it out but they seem to think its as good...
