its weird why some xboxs have this problem with oblivion and the HDD, i'm 30 hours into it and so far its fine

You'll get it the deeper you get into the game I'd guess. Prolly as your char accumulates more items and crap. I didn't notice a drastic slowdown until I hit the high level 20's, and now I'm at 30 something it's so slow that I rarely play it. Cache clearing has little effect now, as does erasing the 750 odd savegames lol
