Community sentence for raping a 13 year old girl.

17 is still a child.
I'm pretty sure a 17 year old knew/knows exactly what the score is in this case though.
There's always gonna be messed up cases blurring legal ages.
His life should be significantly ruined (justice) enough too through the media. Probably easier if he did do time as a legal adult.
 
That poor girl and her family must be thinking WTF! I hope at least he has had the decency and sense to move far away from where she lives. Them seeing him in the same town would just be insult to injury.

This is the problem, Scotland's legal system is so messy they can't even decide what a child is. 16, 17, 18, 25.
 
Even if you forget the age thing, the quoted sentence for someone over 25 was 4 or 5 years. We have a systemic issue here of being lenient on the most serious of crimes and putting too much faith in rehabilitation.
 
There is a real drive in the criminal justice system up here not to criminalise children or young people. Even if a child is found with a knife on them or assaults police odds are they won't be accepted at custody and will need to be taken home immediately for cautioning/charging in front of parents instead. The repeat offenders seem to quickly learn they're untouchable and their behaviour escalates until it reaches a stage that means some action can start being taken.

Which does nothing but leave a trail of victims in their wake.

Somewhat ironic that the post of victims advocate in the Scottish sentencing council is vacant.
 
Just change his name to Ahmed, and I’m sure the sentence will change from probation to 15 to life.

When there is considerable evidence that the police, social services and politicians have previously actively avoided investigations being undertaken into some allegations of sexual abuse in the UK specifically because of the ethnicity of thoose involved?
 
You mean until someone rapes a child and then gets community service? Big action taken :rolleyes:

No, I mean action taken by police, local authorities, social services, Childrens Reporter etc so it doesn't further escalate in the first place.

In this specific instance, without knowing if Hogg had any previous sexual offences or indicators it's quite difficult to say if more robust action could have been taken at an early stage.

From what I have read, he was a 1st offender and didn't reoffend since the incident which, given the timescale of 4-5 years between incident and the sentencing, probably assisted in the sentence given (news stated that the judge mentioned about not offending since it happened).
