Crash this morning

Until there are harsher consequences for people who cause accidents like this, they will continue. Half the time I see them trying to edge out to get in the smallest gap between traffic and don't even spot the motorbike rider.
I had a woman pull across a junction into waiting traffic right in front of me and then calmly start putting on some lippy. She soon stopped when I booted off her wing mirror.

Sadly it'll never happen - death by dangerous driving (as an example) seems to carry a pitifully short sentence, and a poxy driving ban; no justice for the poor soul(s) killed or their family.

I don't think we have the infrastructure to keep people locked up, so half expect the joke sentences are because they need the space (though I'm not basing that on any real stats mind).

A little update the third party wants to pay for my bike as it was written off but it says the payment without prejudice.

My understanding is this not them admitting fault but to pay for the bike to stop the bike hire and storage costs.

What I don't understand is would taking this payment affect my separate injury claim.

Trying to get information out of 4th Dimension(my bike claim team) like getting blood out of a stone, but I will call them and the solicitors tomorrow.

Definitely check with the solicitor but basically it means here's the money to save us racking up costs but by saying it's "Without prejudice" means that if you decided to push it to court they couldn't then just say well he accepted the offer so we're not paying out any extra compensation so I'd say it should have no effect on your injury claim.

By putting 'WITHOUT PREJUDICE' at the top of your letter you prevent this from happening. The phrase indicates that the concessions are being made only for the purpose of trying to reach a settlement and not being conceded in law. It allows you to make a compromise while still pursuing your claim for its full value later if needs be.

Iirc from having such an offer years back, it means that you lose the ability to claim for anything else - basically you are accepting a full and final payment. As your injury claim will be ongoing, this might have an impact.

4th Dimension suck **** from experience, fire off an email to White Dalton - they will often be happy to give you a better idea of where you stand, and may even be able to take over your claim; though they are best placed to give that guidance. I think it depends on how far the other lot have gone with it - I was lucky and hadn't actually instructed 4thD to start work, so was able to bail out after being unimpressed with their service.
 
Without prejudice is them offering payment for your damages without admitting liability at this stage. They are concerned with further costs down the line for injuries or similar.

It doesn't stop you making further claims.
 
Thank you all, I talked with someone else at 4th dimension and my solicitors and they both said what you guys are saying.

Both are separate claims and my injury claim is still being processed it is just a final settle for the bike cost only which I am happy with.
I am sill waiting to get hold of the police officer whose helmet cam SD card but once I have it I can then prove who is at fault 100%.

Now I need to hunt for another bike :D

Well I have always liked adventure-style bikes, and I know 300CC is not much but I am only commuting a short distance.
