Customers PC marked their carpet who's liable?

that is not correct at all.

The customer could absolutely put a claim in and the problem for OP is op would have to prove he hadn’t been reckless in how he had handled or placed the pc. If the customer was to claim it would be a claim of reckless criminal damage under Section 1 of the criminal damage act 1971 as quoted below. It would be difficult for OP to prove innocence as i believe there is no cctv/other witnesses and as such it’s customers word against ops and the customer is the person who can prove his carpet has been damaged.

Hence why i keep saying i personally would be looking for an agreeable solution for both parties.
Laughable. Bringing criminal law into this? The OP hasn't been reckless, how would he know the feet where dirty in the way they were? The customer is the only negligent one for leaving it in such a state, and then asking the OP to move it. By trying to get the OP to replace the carpet, it's a scam.

Yes the customer could bring a small claims against the OP, but anyone could, for pretty much anything, doesn't mean they have a case. If you go through life thinking of the possibility of going to small claims court you would never leave the house again.

I think the case would come down to you proving that they asked you to move it.

I'm assuming they are saying you just moved it without asking?

But if it went to small claims court, how could it ever be reasonably proven either way?

OP should probably just offer to pay for a carpet clean and be done with it.

The customer likely won't get anywhere in court in trying to get the whole carpet replaced

Why is thread even still going? Apart from the comedy value of someone suggesting criminal damage the op has the answers he needs.

Tell them to do one.
Probably the wrong thing to do buy I refunded the pc and sent him £50 on top.. I also realised I spend too much time helping people for no or little financial reward so I'll be telling various people I don't work any more and be more selective of people I'll help (this is a hobby not my main job) . I'll also move to a strict if I'm not there to fix it I'm not touching it (literally not touching it) policy..

One incident in 100s (if not 1000s) of jobs over nearly 2 decades but also made me realise I wasted so much time just helping people for littlr or no money (this one job was probably no profit for 2 visits / 2 hours of my time just because I felt sorry for him as he is disabled / poor)

So you did the work for free, and paid him a goodwill payment of £50?

Tell him to ******* do one.

In any case - in the absolute insanely unlikely event that he takes you to the small claims court, there's just no way he's getting anything.

Gave him a used 24" screen and pc probably cost me £200 but old ish stock I wanted to get shot of.. And took his old pc / screen / printer to the dump for him!

Honestly, tell him to do one - if he makes the frankly insane move of starting legal action on you, over a damn carpet stain, make sure you keep a record of all the free stuff you did for him.

I wouldn't worry about it.

If he'd done that to me, I'd frankly be in two minds about asking for all the free stuff back!

Just why?? Someone tries to shaft you and you just bend over and help them. Hopefully it’s a cheap lesson learned.

Stick a virus on the PC.

Blame user and charge them £ <insert cost of new carpet> to come out and repair it.

I always think just because someone is disabled / poor / old or whatever it does not automatically make them a nice person who I should feel sorry for. IMO you went above and beyond what you needed to do. I would have just cut contact and ignored them. Even now there is nothing stopping them leaving a bad review. I've found people like this are never happy and whatever you do will never be good enough and will still complain.

are you available to come and work on my pc next weekend ?
I have a slightly painful ankle.
I'll be needing an RTX4090 and fitting for free please.
(I'll settle for a 4080, but you'll have to provide a new case as well)

and if you could knock one of the plant pots in my drive over when you arrive so I can make a claim with you afterwards that would be most helpful.

Just thinking, I could actually do with a new bedroom carpet
Well, apparently it's easy to do. You just put some oily substance under your own property, then tell someone else to move your own property, once it's created a stain, you take them to court and get a new house. Also make sure you phone the police, because it's crime, apparently, and this individual should be sentenced to death by putting him on a spike at the mouth of the Thames, to warn off evil spirits.

or being reckless as to whether any such property would be destroyed or damaged shall be guilty of an offence
Surely claiming he was reckless is a little rough?

OP, I think I might send him a carefully worded email or a letter covering points such as -
  • Your understanding of their frustration over what has happened
  • You were trying to help, as you have for free, many times before
  • They gave no warning that this could happen
  • There was no sensible expectation that this could happen
  • Because of this, you feel their request is not a fair one
  • It's a shame they are taking this angle as you will no longer feel comfortable helping others in a similar situation
I guess then decide what you want to offer, if anything.

if where he picked pc up there was a big black mark, and it was semi-stuck, then there would have been a warning ... presumably there wasn't , otherwise, he'd have some responsibility.
