Pedestrians usually have right of way, but not always. Anyway it doesn't mean they avoid blame if they are stupid. Plenty of people have walked out from behind parked cars, or run out in to moving traffic on a crossing (without leaving time for people to actually stop) and been run over, only to receive a bill for the damaged caused to the car that hit them.
