Did someone delete an XBox modchip question?

indeed, which is silly, as long as it doesnt use/modify MS code, a modchip is 100% legal.

Its only the code which makes them illegal, and there are plenty of nonMS coded ones around.

Once i buy a machine, if i want to wire a toch and cigarette lighter onto the motherboard, i can. Same applies for anything i choose to do with my purchased XBOX

As long as it doesnt modify or hack code which is protected by law, its legal to do whatever the hell you choose with your purchase.

The banning didnt ban on the basis of mochips, it banned on the basis of modifying intellectual property (ie software), so a LINUX modchip on an XBox shouldnt be illegal.

Er, not wanting to get into an argument with a mod here but while PS2 modchips are illegal, XBox modchips are not actually illegal. They are supplied with a legal (Cromwell BIOS) and can be used for entirely legal purposes such as running Linux for example.

So the question was totally legit and didn't break any rules regarding legality as he didn't ask for information on installing or where to get an illegal BIOS or any other dodgy software.

seconded. "Rules are rules", but if im to follow a set of rules shouldnt those rules be justified?
 
Erm, read the actual decision Brainiacs ;)

The reason the judge declared it illegal was not the use of Sony's bios, but the fact that the chips are used to circumvent copy protection systems which is a breach of the European digital rights act, so the judgement applies just as much to Xbox chips as it does to PS2 ones.

You may not like it, but at least try and read the information and the decision before you make yourselves look silly with irrelevant points ;)

1) They're not 'silly or irrelevant points'

2) Unless Microsoft take the issue to court Xbox modchips remain legal. There are many online retailers selling XBox modchips perfectly within the UK law.

3) The faq states "Providing or asking for information regarding "warez", "gamez" or any other software protected by copyright is forbidden." so anything posted has conformed to the rules.
 
No copyright is being breached by an Xbox modchip, so the same case could not be brought, which surely means it can't apply to Xbox modchips..
 
yes you cant make a blanket desicision on this. Sony themselfs took the case up remember, not microsoft or nintendo or anybody else for that matter. The court rules that ps2 modchips are illegal, not once did they mention any other type of modchip.

This is just my opinion. but you cant compare ps2 modchips to xbox modchips since the sole purpose of a ps2 modchip is to play copied games. The same cant be said of an xbox modchip. I can't see how using my modded xbox to play my music collection or stream movies from my pc constitues to warez, and neither does using it to store my (legally bought) games on my xbox's hdd for that matter.

I can see where OCUK are coming from i mean its their forums so if they set the rules we have to stand by it.I am sure if people want to find out about modchips etc you can find all the info if you just use google.

The only way you can get to stream movies across to your xbox and backup games to hd is to use the tools developed with the ms xdk which in turn is a copyrighted program.

Ok, so we all know that technically an Xbox modchip isnt illegal when bought, but come on, saying that your only going to be using it for a linux media centre with a legal BIOS is a little bit tongue in cheek.

It far easier for OcUK to just have a blanket ban, a) for legal purposes and b) to avoid the argument of someone seeing an Xbox thread then thinking its ok to start a PS2 chip thread, then crying when the thread gets deleted.

There are dedicated forums out there for specific mod chip talk, so theres absolutely no reason to bring it here.
