Ebay returns problem

his next reply.. when i replied why would the pc repair shop lie about the card not working..


I have no idea why they would lie! All I can tell you is that the card is
fully working. I've spoken to an eBay representative online this morning
stating my case. Unfortunately for you, as far as I'm concerned, this
graphics card belongs to you. It is in full working order and is in the
c0ondition I stated on my ad. I have broken no rules nor have I misled
anyone. The card is exactly as I described in full working order. In fact,
it came back from you in worse condition. I had to bend a lug for the
holding screw. I will email this PC shop you say tested the card expressing
my concerns and disbelief!!!

It is not my intention to hoodwink anyone &
I stand by my 100% positive feedback. I have fulfilled all my obligations
as a seller. If you want, I will relist the card & I( will give you all
proceeds of the sale. That means if it sells for £27, you get that £27
minus the paypal fee. If it fetches more, you will get more. I cannot offer
more than that.
 
His next email. I've not said anything to him. I replied to this one saying i plugged the graphics card into my psu and assumed the pc repair shop did the same.


The shop you sent the card to are way off target and they are out of order.
Admittedly, it seems this card only runs with external power. As a buyer, I
assumed you'd be aware of that. I will make a video this weekend showing
you this card in full working order since you sent it back to me. TBH, I
don't see why I have to keep defending my name = I don't lie and my
feedback should show that!

PS: I found the missing piece of
the fan. This should not have broken so, looking at the card and the
condition it came back in, I'd say it has been handled with a heavy hand
(that's just my opinion)
 
He now doesnt want me to post the above back ^^^ talking about the expense incurred to me...weird!

Anyway he's waiting on the "ebay adjucation panel" and a reply from the pc repair shop.
 
It's funny reading these threads about ebay disputes.
In no way am I calling the OP a blagger or being dishonest but 90% of these threads are from the sellers perspective. The usual line of responses being the buyer was a noob who realised their pc didnt have a pcie slot/suitible psu/ yadda yadda so claims it faulty and wants a refund. Either this or a scam and try to return a different peice of kit. The general consensus being to tell the buyer to "do one".
This time its the other way around and I honestly did think this was a joke thread to correspond with another thread about some scrote who bought a graphics cards on ebay and is now claiming it was faulty when our intrepid OP, the seller of said card (who being a member of ocuk forums obv knows a thing or two about computer hardware) knows his kit to be in A1 nick.

In this case the seller does seem to know what he's talking about and seems to be doing what he can to prove the card does work (with the vid etc). Also the business with the card needing external power - presumably we're talking power straight from the psu rather than just through the PEG slot?

He's being quite reasonable offering to relist it and pass the proceeds on to you, I'd probably tell you that if you wanted it back you'd be paying the return postage.
 
You have absolutely no need to accept anything less than a complete refund (minus return postage). Stick to your guns. Keep the ebay dispute up to date in the resolution center by always replying to his messages. Even if to just say you disagree (each time you reply, the timer resets and he has to reply within a certain period, otherwise it will automatically escalate). When you're able (8 days?) escalate the case immediately. He virtually cannot win. Believe me, as an IT ebay seller, I've never ever won a case. I literally don't bother fighting anymore, and refund ANYTHING that's requested, no questions asked. He cannot win. Not in a hundred years.

Escalate the case. Stand your ground. Don't say anything stupid. Don't admit ANY kind of liability, on your behalf, or on behalf of the IT shop that tried to fit it. Simply state that it was not as advertised, didn't work, and has been returned for a full refund; nothing else is acceptable to you. And that's it.

Most importantly, stop sounding like a ninny and getting worked up. If you had any idea how hard it is for a seller to win a case (again I'll tell you, it is virtually IMPOSSIBLE) you wouldn't be remotely worried. Your money is being held by ebay right now, and once escalated they will release it to you. That's it.
 
To add. The only thing he has at his disposal is social engineering, and your potential stupidity. He's fishing.

There is no "ebay adjucation panel", the only people that will pay any attention to it will be the resolution center dudes /after/ it has been escalated. And they will only look at the messages sent within the resolution center. Not the messages sent through the normal ebay messaging system. Talking to you outside of the resolution center messaging system is a great way to coerce you without running the risk of being penalized for doing so; so address him only within the resolution center.

"I've spoken to an eBay representative online this morning stating my case." - means absolutely nothing. And is designed to scare you into either getting screwed over, or saying something silly. The ebay rep he spoke to in an online chat did not in any way give him an indication that he stood any chance of keeping your money. They follow a specific script. And the first and only thing they will have taken into account is the tracking information for the returned item. Nothing more. It was sent back to him. And that's all they care about. Literally.

I've talked 4-5 buyers who've returned items into screwing themselves (only ever unscrupulous liars..). The only chance he has of keeping your money is by convincing you that he has a shred of power/chance of winning; and having you agree to something silly. Don't do that..

go to the police, do what the **** you want but I am NOT giving you a
penny. The card was sold in good faith and was properly advertised. You
just changed your mind because you bought the wrong card. The card is
absolutely FULLY WORKING! You have lied all the way through this since you
realised that it needed it's own power supply. Also, I wouldn't be
surprised if the guy at Control Panel is a friend of yours 'in on the
scam'. I'll be showing this video to eBay too btw.

If the card works then fine it mustve been a fault with my pc and the pc repair shop mustve messed up testing it somehow. I'm thinking about going down to the repair shop in the morning to make sure they know what they are doing and they didnt make a mistake somehow

It's a dude, just watch the video... I wouldn't want this guy turning up at my door to sort it out in person :eek:.

The card appears to be working. The fan looks a bit dodgy being glued together like that though. Was that like that when you got it from him?

That video is brilliant. I think Vic is right on this one, you're doing something wrong. Just get it back and sell the thing on, or as Vic himself kindly suggested, let him list it and then get the money from him.

As you can tell, I like Vic. :)
 
It would be clear cut if not for that broken fan. That doesn't look like it's going to hold up very well. Was the broken fan mentioned in his original listing?
 
Well i never once started verbally abusing him.... i did what most people would do if a pc component didnt seem to work....took it to a pc repair shop.

But your right video looks spot on nothing wrong with card so i don't know what kinda crap The Control Panel are telling me...... :(

But i'll go down tomorrow and have words with them..
 
Read the thread, Mark. The broken fan is mentioned earlier on. Post 15.

I have read the thread, I was asking if it was mentioned in the listing. I wouldn't be happy to receive a gfx card with a bodged fix like that. If it was shown in the listing then fair enough.
