Ebay unpaid item strike

Hi guys.

I have received my first unpaid item strike, and I'm really annoyed.

The story...

A month and a half ago, my Dad asked me to sort a gift out for somebody. I said sure - but time was tight. The item needed to arrive pronto.

I found the item I needed - £80 - at an Ebay powerseller on a Buy it Now. It was an Ebay Shop, the guy had hundreds and offered next day delivery.

I clicked buy it now, and proceeded directly to payment. Went to pay via Paypal but it wouldn't let me. It said I had reached my sending limit, and I had to verify with Paypal. This would take up to 5 working days.

I did not have 5 working days. The only other payment method the seller accepted was personal cheque - again, this would delay the shipping and I needed the item fast.

I found the item elsewhere, for £10 more, at a conventional online store.

So, I emailed the seller. I explained the situation, apologised profusely for the hassle, and offered to pay his listing fee.

He did not reply.

A month later, I get a message from Ebay saying the seller has filed a non paying bidder report. I'm obviously a tad miffed at this - I think I was quite reasonable. I am offered the chance to discuss the issue via the 'Dispute Console'. Again, I am totally polite. I basically re-tell the story, and once again apologise and offer to pay the guys listing fee.

He did not reply. Totally ignored it.

Today, 7 days later, I log in to find I have received an unpaid item strike.

Am I right to be a little narked, or is it my problem for being a 'non paying bidder'?

It was not an auction - so it's not as if some guy had been waiting patiently to sell his item for a week and I went and screwed it up. It was simply an Ebay store - nothing more. I liken my situation to taking an item to the till only to find your credit card is rejected. I was very polite, very reasonable, and the seller didn't ONCE bother to contact me himself, or reply to me.

What can I do? Put it behind me and move on, or is there any way to challenge this? Ebay state I can only challenge it if I have proof of payment :(

It just feels so... unfair.
 
You won an auction (online store or not), which is a contract and you didn't pay. That's the bottom line really.

Accept it, move on.

I just feel hard done by becuase the only reason I didn't pay was becuase Ebay themselves would not allow me to :(

I even offered to pay the guys listing fee, leaving him in no way out of pocket whatsoever. He did not even have the decency to reply.

Unfortunately this is right, although I can see quite clearly where you are coming from. Sellers in this case have a lot of power and now it looks bad on you when you have at least tried to offer the listing fee in return. I believe if you contact the seller, he or she can remove the strike by mutual agreement. Give that a go :)
 
Although it sounds a bit unfair and unreasonable for the seller not to discuss the matter the fact is you didn't pay, and that's what the strikes are for.
 
I thought the strikes were there to stop people bidding on auctions then deciding actually, no, they can't be bothered.

I guess there is no way to differentiate between people like and people like me, whose only reason for non-payment was the patheticness of Paypal, who *refused* to allow me to pay even though I had ample funds available :(

If I moan enough, I might feel better :p

My right to feedback has been revoked for this transaction. He has not neg'd me YET - which I guess is something. I imagine he will do, though.
 
If the score is that you won an auction and then decided that you didn't want to wait for the item so you chose not to pay instead then it looks like you're in the wrong.

I see why you didn't and it's unfortunate but at the end of the day you have agreed to buy the item from this bloke then changed your mind.

Harsh and it seems this bloke is quite unreasonable but that's how it works. :(
 
Well it is a contract and you should have known before bidding. However, the seller must think hes higher than you to do that, any decent ebayer whether he or she has 10k+ feedback should be understanding. Idiots who think because they get bigger in their business they are mighty, really peeve me off -.-
 
All you can do is write a polite email to eBay explaining everything, explaining how you didn't know that your PayPal account wouldn't work, and that you emailed the seller offering to pay his fee's and that he has not responded on more than one occasion, they may be sympathetic... but at the end of the day, it is how the others have stated, you won the auction!

I offered to pay his fees. He did not even offer me the courtesy of a reply. I have had zero correspondance from the guy, at all.
 
I'd have offered him his listing fee + £10 for his trouble then, if he refused, bought the item anyway and sold it on. Just offering the listing fee is probably what annoyed the seller - you bid, you won, it's not his fault you can't pay but he would have to go to the trouble of relisting and holding the item for at least another week.

Edit: Oops, just noticed it wasn't an auction. Perhaps the seller was a little harsh in that case however I'd still have offered him something by way of compensation.

I think one of the points was he had no way of buying the item
 
I understand your annoyance mate. I doubt you'll get the unpaid strike revoked by eBay, you'll need to get the seller himself to do it.

What'd annoy me more than anything else is not the unpaid strike itself, but the fact throughout the whole ordeal the guy hasn't even been able to extend you the simple courtesy of replying to your emails.
 
Its a shame Ebay and Paypal both suck when it comes to dealing with its customers. He should have emailed you as you made the effort to email him, good luck.
