btw i had emailed ebay to let them know that the seller was asking for it to be returned to a different address...incase the seller had't.

when seller did not get back to me and ebay did not get back i sent it back, ebay then replied saying not to worry and that the seller has received the item and that they have requested the seller to refund me...

well finally got off the phone with ebay, they have decided to issue me with a refund as i did not do anything wrong and it was the seller who was at fault for not updating his address.

Result! How you could ever have been at fault for following their process is beyond me.
 
I have found that with most companies you have to try twice to get a result. First time they have some **** skim read and do the simplest thing / default response and then when that doesn't apply to 50% of cases they actually look into it.
