So,im still puzzled after all the hassle of him wanting a instant refund he hasnt escalated yet?

Ive posted my receipt and tracking details as Paypal have asked for them on the page when i write my comments.

Btw thanks Halk you have been the main contributor in this thread and have helped me a lot so i thank you for that.

I don't need to take any action because I've not received it, but if you look up the top of it you can see the Dispute > Escalation > etc

Paypal only asked them for the tracking number after escalation, so do you think he may already have escalated?
 
No mate,as the tracking info that i supplied was not requested as such i dont think,there was a little box beside the comments page,so i supplied it there.

Ive had no email from paypal asking for this specifically

So your waiting on a parcel too?the company your having probs with have also been good for me regarding delivery and RMAs etc,though there email support is dire
 
No, OcUK was out of stock on a case. I found it elsewhere with free delivery for the same price. During the order the offered it to me on the 20th of Dec for an extra tenner. By the 21nd I didn't have it so I contacted them. When I logged on to their site they had it listed for Dec 30th despatch. I messaged them and said that wasn't on, either cancel the order in full, or refund the next day delivery charge. I asked them 3 times, each time they came back and said they couldn't refund the delivery charge but they didn't cancel the order as I had asked them to. I got fed up and created the Paypal dispute, yet a week after I created the dispute they sent the item out. I refused it when it arrived, and I'm still waiting for my money back.
 
The case has today been escalated,ive been asked for my prove of postage which ive submitted to Paypal.

I had till the 11th but have submitted straight away,i should have waited till the 11th and made him wait really,but i didn't read the email properly,oh well:).

Mine has stepped onto the next stage. The last stage made it look like Paypal would arbitrate today, but they haven't. The status shows it is being reviewed by Paypal.

"We'll contact you with any developments or if we require additional information from you by 26 Jan 2011."

So I guess I now have to wait for another 2 weeks.

This is one step ahead of you I believe.
 
I'll be fine. As noted Paypal usually favours buyers, and unless I get a refund it'll be clearly illegal since I'm dealing with a company not an individual.

I still think you'll be fine though. While I'm not pleased my refund is being delayed, I'm pleased your case will face the same 2 week wait. By that time Royal Mail will admit losing it or it'll be delivered.

However... when the mouse is delivered. Will he claim he didn't receive it, or will he then try and get you to partially refund it as it isn't what he requested. Or will he damage it and say it never worked.... If he's as bad as he's shown to be you never know.

On the other hand if it's a scumbag who lacks the £40 to buy another one them perhaps when it does arrive he'll just simply keep it and be happy.
 
Geez next time just send the damn thing via special delivery....charge £7 for the pleasure...that way it will be delivered next day by 1pm...simples really...why people continue to use recorded mail for something of high value just truly truly astonishes me.
 
^Special delivery would be more than £7 for the mouse and its packaging and the box ive used.

Also using Special delivery there is still no guarantee it would have been delivered because of the snow we had,you do realise Royal Mail are still backlogged now with Special Delivery items aswell,RMSD was certainly not guaranteed for next day when i sent the item over the Xmas period .

I paid £4 for recorded,special would have cost more,a lot more.

£40 is hardly classed as high value is it?,if i sent something maybe £80+ yes i would have used RMSD.

Ive sent over 100 items using recorded 1st class with Ebay and a quite a few items on here and never had any problems till now,so yes im confident that recorded 1st class is still a decent service.

I am sorry you are unhappy, but you are being entirely unreasonable. We have had exceptional weather and it's common knowledge that Royal Mail have struggled to cope. Your item is still in the delivery chain and I'm confident it will arrive. If it does not arrive I will not hesitate to refund you in full, and I will handle claiming from Royal Mail.

You can see Royal Mail's tracking of the item here (link it). As you can see Royal Mail still say they have the item and are going to deliver it. I have checked and Paypal policy is to accept Royal Mail's tracking information. If the item was to be lost Royal Mail will update the tracking as lost, and I will refund you.

You can of course raise a Paypal dispute. Paypal require you to allow 7 days before raising a dispute. Once the dispute has been raised you must wait 20 days before Paypal will become involved. After the 20 days has run out Paypal would request the tracking number from the seller and the courier used. I would supply them with the Royal Mail tracking number, and Paypal would place the claim on hold until either Royal Mail tracking said the item was delivered, or the item was lost in the post.

Raising the dispute will not cause Royal Mail to deliver faster. Additionally should they lose the item in the post it will instead delay your refund as I cannot send a refund while the dispute is open - as soon as you raise the dispute Paypal will seize the money.

But personally i would end it with something a little unpleasent due to the fact that the guy is a timmy o tool.

Recorded delivery items are covered up to £40, why bother using special delivery?

The 'tracking' on special delivery is basically useless too, last time I used it, all it said was 'your parcel is on its way' or words to that effect.

I had one of the rare cases recently when Paypal took the sellers side for no particularly good reason.

I bought a graphics card which I paid about £40 for. The item condition was 'used' but there was nothing to state there was issues with the card. When it arrived it was faulty (crashed when gaming, basically any game so didn't think it was a driver issue, tried more than 1 driver). Asked the seller for a refund, wasn't offered. Opened a Paypal dispute, Paypal decide to take the buyers side because they'd stated 'didn't accept returns'. However under the rules of eBay they should always have to accept returns if an item is significantly not as described. :(

Ive come to accept now that the £40 i have lost,due to the way the buyer has conducted himself and the manner in which he has been towards me ie: every email 4-5 i get threatened with negative feedback for something that isnt my fault,i would have maybe refunded him if he wasnt such an ass. But now i will be awkward and just make him wait.

If Paypal refund him and the mouse is delivered and signed for which i can see via the tracking,will Paypal refund me then?

I suspect not as they are simply cowboys from the storys ive heard regarding sellers.

Exactly thank you,the mouse was sold for £40 and was insured for that amount.,special delivery is simply for items that are worth more than £40

Im so so so glad the item is only for £40 as this could have been so much worse for me,ive now come to accept that 99% i will lose the money,i will also never ever again sell on Ebay after this episode

Didn't you withdraw the funds to your bank acount?
 
SB118, what are you saying? Are you suggesting he should empty his bank account so that Paypal can't get the money back? I don't recommend that at all.

No i wont be doing that,thats just silly especially for £40 and the risk of being blacklisted.
 
Have eBay put a date on your dispute yet? If it runs like mine the buyer has to respond within about 5 days to see if he has received the goods as per the tracking number you gave. If he hasn't received them he lets it run and then it goes to what mine did... which is a 2 week wait for a Paypal response.
