Gigabyte Gaming OC 2080ti Problem -do I RMA?

It doesn't matter what the cost is.

Your warranty is with ocuk... Therfore its their duty to replace it. All they have done is take the liability away from themselves.

I'd personally be calling and asking for an immediate replacement.

The contract is with OCUK, but if OCUK's process is to send the card to the manufacturer then there's nothing wrong with that. They are under no obligation this long after purchase to simply replace on the spot. They will only need to replace if Gigabyte take too long to return a working card, and I'm sure they'll do that if it gets to that point. Hopefully for OP Gigabyte will have the card back in a couple weeks and all will be well.

But they are not obligated to do so, same as Currys aren't obligated to replace your washing machine on the spot if it fails months after purchase. They can opt to do so if they want to (and it is common to do so on cheaper items as it is more economical to do this than repair) but under CRA2015 repair is acceptable as long as its done in a reasonable timeframe.
 
Is the 28 day period start when Gigabyte receive the card or is it when OcUK first receive the card? - I have a feeling I already know the answer to this though.....

Had no pc to game with since 24th Feb so hope Gigabyte are operating a fast turnaround (fingers crossed).

@GIGA-Man might be able to help you out here. top bloke on the forums who has, probably single-handedly, really built gigabytes brand name due to the support he offers end users on here.
 
Update 2 :

received an email from Overclockers a few days ago stating that they have not heard back from Gigabyte and as this Monday will be 28 days I can call to ask for a replacement from their own stock. I am so looking forward to getting my pc back together.
Really hope they will have some in stock (presently 1 in stock) to replace mine with. I look forward to posting some good news.
 
I've noticed today the same model that I RMA'd (Gigabyte 2080ti Gaming OC) is now out of stock - will OcUK replace it with only another Gigabyte model or will it be from any manufacturer does anyone know?

Possible they've pulled it from stock to send to you, but if not they'll sort it one way or another. Options when the exact same product isn't available usually are agree to wait for stock (assuming they know when its coming in) alternative product of a similar value, or refund.

Called OcUK this morning hoping to be told that a new card would be sent out to myself today but unfortunately was told that the webnote I received last week stating that this would happen today was incorrect and that it is 28 days from when Gigabyte received card not from the time that they receive it. They said they were hoping that my 'repaired' card would be in a bundle delivery from Gigabyte later this week. To say i'm disappointed would be an understatement. Living alone and being ill for last five weeks I really could have done with my pc and have my hopes raised by the webnote last week just to be let down today hurts a bit.

I just have to be a bit more patient. If Giga-man is reading this could you possibly help and look into it?

I feel your pain matey I really do, health issues as well.

My fans were playing up on my Gigabyte and is being returned today ( under 14 days, well under a week old! ). OCUK and RMA has always been a worry for me, and it didn't exactly go off to a good start either.

ps Makes you wonder if Gigabyte are using cheap fan kits!

Remember, your contract is with OCUK, not Gigabyte. Therefore any terms in CRA2015 regarding timeframes are between you and OCUK.

It seems fan problems on Gigabyte cards are quite a common occurrence. I was so hoping and expecting OcUK to tell me a new card was going to be sent out today; instead I have to continue waiting and i'm not sure I want a 'repaired' card rather than a replacement. Just keeping my fingers crossed this will be sorted soon.

At least your card is under 30 days old so should just be replaced. All best to you.

I'd like to thank Jargan for his updates and replies to my messages. Have received email confirmation that my 'repaired' card is being shipped back to me. Fingers crossed that it all works fine now.
 
Update:

Received repaired card back today installed fresh Win10 (still unable to activate for some reason) and installed all drivers etc. The graphics card has changed somewhat, what I mean is all fans are now idle (currently at 46 degrees) but when load up a game all fans go like a hurricane. Am worried that if I use msi Afterburner and alter the fan curve it will mess up.

Are everyone else's Gaming OC 2080ti fans idle until heavy load?

Should I be worried?
