If you wanted a warranty replacement yes you would have to send the old broken one back... else we would all have big piles of drives next to our desks.
Andyour first Q... There if nothing to say that a drive 'has' to show an error before it dies. An engine light on a car doesn't always light up before it breaks down for example. Best bet is to always keep a fairly up to date back up just in case, and monitor you drives health with an app like speedfan to try and foresee any issues.
