and the fact as its been noted here all or most major sites just use the inbulit gpu test or another benchmarking tool and dont' take ingame fps into account ocp does this with min avg and max so thats why its more than likely this is a better account of what the card can do!!!
and for ati to come in a year behind the gtx with a 300 quid card that hardly beats it is laughable tbh 512gts is the way to go till better cards come out!

In fact, it's not hard to make a case that timedemos and graphics only benchmarks are a better indication of relative worst case scenario performance. In a situation where graphics is the largest bottleneck in the system (which is not a rare occurrence), a graphics only or timedemo benchmark will even more accurately predict relative performance.

Who's right who's wrong? ive no idea. Imo its up to the individual. To address your last point, if you think beating a card by 40-50fps in some games is hardly beating it then amd and nvidia may as well stop work right now...
