there was a case a few years ago when a man had sex with a girl of 10 who (apparently) looked and acted a lot older. i don't think the bloke was charged on the grounds of her provocative behaviour. she'd been in care or something and sounded like she had learnt some pretty questionable habits from older people.

Yeah agree with this. No one is innocent here.
While the guys apparently treated them like meat, it's clear one of the girls was more than happy to be 'meat'.
In general you should be able to tell the difference, however, I remember 2 girls in first year of secondary school, they had big breasts and looked much older when dressed up (or down). Just like some 16 year olds look about 12.

Does a 12 year old really know what she was allowing though. Not in any way excusing her behaviour, it's just hard to judge. If a 12 year old sleeps around I think it's more about influence from someone else and not so much personal wants.
I can't even remember how I was thinking when I was 12. And when I was 16 I realised how immature I was. And then again now how immature I was when I was 16.
Just where does the line go when it comes to being held accountable for your own actions. Either way, the two 12 year olds clearly need help.
Do they deserve to be sent to jail? Hard to say without seeing the girls and the reaction to being told their real age. But they were a bit dumb to just pick up these girls and sleeping with them as if it's nothing.

If they did act like slags and say they were 16 then i dont think it was the mens fault. They were horny and the girls were stupid *******. Wearing a mini skirt is one thing but then tellin people u r 16 and can have 5 at a time is bound to attract loads of attention. If someone was prosecuted for picking someone up in a club that turned out to be under 16 I think that would be extremely harsh. If a girl is prepared to pretend to be a certain age then I think the responsibility moves onto their shoulders and away from the man. Obviously I'm not talking specifically about consensual sex with say a 15 year old that is picked up in a club where the minimum age for entry is 18.

Yes you really can, did you not go to school or something? It can be very hard to tell the age of some people, especially those type of girls who do it purposefully to hide their age.
This is the whole problem with the situation, you can't categorically state that they didn't look 16, but in fact looked 12, as if it's simply impossible. At the age of 13, I looked like I was over 18 and many times, say when getting train tickets and that, I was accused of being 18-20 many times when requesting a child's ticket.
They way a lot of people in this thread of acting is quite bizarre, I'm not saying what they did was right, but you're simply looking at the girls' ages and stopping there. One girl in my class at school was with some guy who was in his 20s, who believed she was also in her 20s, she really did look it, as well as being dirtier than poo on a stick. In such a situation, I'd put the blame on her rather than him.
My point is basically, stop saying it's impossible because it really is, and clearly does happen.
Thing is though when it comes to stuff like this how many people would actually be 'asking for id'? I mean if it's giving someone a cigarette, drink or whatever sure - but if you've got a girl coming on to you and you suddenly come out with that line it would likely put a dampner on the occassion. "Hold on a minute, just going to nip home and get my passport, I completely understand you not believing me when I say I'm 16..."
I'm not suggesting people should be going ahead with it if they have doubts, just that I really can't see that many people being as forthright as to come out and ask them for ID straight up, as if the girl is of legal age she might get offended at being called a liar.
As an aside (and something probably for a different thread) one thing I find really interesting is the attitude people have towards under16s sleeping together compared to young adults sleeping with under16s. If a kid of 15 loses his virginity to a girl of the same age it is all "well done lad", if he's a couple of years older he's a pedophile, and personally I don't believe all people in their late teens are more mature/responsible than all people aged 15 (since I know the argument is that an adult 'should know better, is in a position of responsibility bla bla'). But I'd say shouldn't we be cracking down on the youngsters too?
