So you're permitted to trade items "for free" but not if real-world money changes hands!?

Err, what business is it of Blizzards whether real world remuneration takes place in such trades? Either permit them or don't but whether money is involved is **** all business of theirs IMHO.

Because the items belong to Blizzard, not you. Thus, you cannot charge money for real life gain for an object that belongs to them.

They state this quite clearly in the T+Cs. All characters, items and other ingame paraphenalia are the property of Blizzard and may not be sold blah blah blah. I don't remember the exact words, but that's the jist of it.
 
It's nothing like a shopkeeper throwing you out of his shop. A more accurate metaphor would be you paying £20 to go into a nightclub then getting thrown out half an hour later for absolutely no reason and with no evidence against you.

Hehe, funnily enough I have seen exactly that happen at a nightclub, also saw someone thrown out of a football match for insulting the linesman, even though he hadnt said a thing.

As I say, I would love to see 1 person, just 1 single person, anywhere in the entire world, successfully take Blizzard (or indeed any MMO dev for that matter) to court for having their account banned. Maybe its happened, I mean surely if it was possible then at least just 1 person must have done it, but I very much doubt it.

If anyone here fancies trying though, by all means give it a shot, if nothing else it should make an interesting read

The point is the account potencially has a lot of time invested in it, and quite possible could be worth £300 +


Surely the OP wants to do anything he can to sort it out?

If it's a new account consider it karma, wow isn't that great to get into anymore.
 
I was under the impression that it was against their rules to sell an account, so it cant be worth £300+ :)

Don't act like you wouldn't sell your account tombstone, it's not exactly hardcore drugs :p

But if your talking in a legal sense sure, but still who cares about the legality it could be worth £300+!

Actually, when I left WoW , I didnt sell my account. Nor did I sell my accounts when I left any of the other MMOs I've played over the years :)

What's strange is my main character is still there and intact with all items and gold, but, my low level elf has been deleted and in it's place I have a level 1 warrior residing in the Barrens :confused:, still I can't complain, I'm just glad I got my main character back :), I guess the friendly email approach was best, perhaps my unhappy smiley faces scattered about the email helped too :o:D.
 
Indeed and L1 in the barrens would suggest a trading gold character, which also indicates it was hacked. Make sure you keep you're antivirus up to date, and many people report that the free AVG scanner misses a lot of keyloggers in case that's what you use.

And change the password to something completly different than before.
 
cheers, I've changed my password, it has numbers an letters now, I'm using avast anti-virus atm but tbh I'm not a great fan of it, I think I'll stump up and get nod32, I know this is a bit naughty but if I pay for nod32 can I get away with using it on 2 machines ?
 
But end of the day I haven't actually done any such acts so on principle I will be threatening them with court action, I know that sounds silly and probably nothing will come of it but it's not about the money, I just don't like being told I've done something that contravenes the EULA or whatever when I haven't done anything wrong, I've had that character for a few years, I spent 1 year levelling it up slowly and stopped for about a year, until recently that is, and then I get that email sent through without warning, I'm not a happy chappy.

They didn't ban you just because they felt like it, they have proof that your account/character has been involved in illegal acts/acts against the EULA. Just a fyi. By all means take them to court, but you're going to be pounded and you're going to pay the court fees.

I reckon you were the victim of keylogging and account theft. Has happened all too often.

Blatant account theft. CLEAN YOUR MACHINE ASAP. Change your password, and clean your machine again after that. Change your password every month or so.

What has happened is that you have been keylogged, and the account details used by gold farmers to create a level 1 character to advertize gold selling services with. As it was in the Barrens, this is highly likely - it's a zone with a high population. Was the name of the level 1 character a bunch of random letters?

Because it's happened to you once, the gold services now know you are complacent and lack security - they will go after you again.

visit a neighbour

goto the park

phone a friend

have a go at a crossword puzzle

there are so many things in real life that you can do now , and with all your free time, you may meet someone special.


oh one last thing, .. welcome.

It's not that complicated, I wouldn't laugh at the OP for losing something that mattered to him.

Glad you got the account back in the end btw.

I don't understand why game companies consider themselves completely above the law when it comes to things like this.

Imagine if you were using any other service (which you paid monthly for) and they suddenly barred you completely for no reason, and gave no refund. People would be up in arms.

By all means take them to court, but you're going to be pounded and you're going to pay the court fees.

You wouldn't get pounded at all. An EULA has never stood up in court, they can't just whack anything they want into it. If it said "We have the right to kill you at any time you are using the service" well, no, they don't. Same with any other rubbish they put in.

ask for the date there saying that you have RMTD then say you can get a bank statment showing you didnt pay no body / websites / paypal on that day
