Hit & run

However, I've been told that I won't get a hire car as it's a write off and they have no one to claim it back off. They also tried to make it a fault incident, but I said I don't feel at fault because of the above, plus the fact that he was overtaking some parked cars at speed (it's 30mph) when he hit me. They've told me that I'm entitled to legal support to make a personal claim off the moron who was driving, yet I still can't have a hire car.

Does anyone know where I stand with this?

You take out fully comp insurance for a reason and then they try and turn it all back on you. I'm REALLY annoyed now I've read this, makes you wonder why you bother insuring vehicles at all sometimes. Don't stand for crap from them and get legal help if you have to. I've lost count of the number of friends and myself who have been screwed out of legit claims from insurance companies pulling out legal muscle and twisting the meaning of the small print :mad: :mad: :mad:
 
I don't know why you're angry with the insurers, they're only following the contract that Kate signed up to. It would say exactly what happens in a situation like this, cheap premiums are cheap for a reason!
 
That really sucks Kate :( If there's a third party insurer to claim off (and it appears there might be), I'd follow the advice to get a third party provider (europa, helphire etc) involved to get you a car for now.

Hope you get it all sorted soon.

Sorry to hear this. Another S14A bites the dust :( Post on the SXOC if you can, there might be some locals willing to help restore it to its former glory.

Hope you get a swift result from MIB / 3rd parties insurers.

Glad you are ok. Seems very lame that you can't get a courtesy car. Always amazed that if an uninsured driver hits you, you can be put to fault and have to pay an excess. It just shouldn't be that way.
 
Leon could fix that with a hammer, some T-Cut and duct tape ;)

That was a really cool and nice car. I really hope the insurance company actually sort it out because that really is unfair, I never have understood why it's almost easier to get away with no insurance than it is with it. :(

Will you be getting another down the line?

You can get policies that ensure this doesn't occur (such as with direct line) but a lot of the time people search for the cheapest quote thinking all insurance is the same.

Re Dolph: Even with DL I don't think you're safe from un-insured loss.. I had a freind a few months ago who was hit by an un-insured driver.. she was hit from the side of the road as he was reversing out into the outside lane of a duel carriageway (idiot) and they STILL charge your excess, and afaik you only get it back if they make a successfull claim through the courts.. I remember her telling me because she was charged her full £250 excess for the repairs.

You're not totally protected (they have to prove it was the fault of the uninsured driver as per the link provided) so if a court says it would go 50/50 or whatever, then you aren't going to get the excess back.

However, it's better than the zero protection you get with most insurers who will not cover it unless they recover all costs, not just get a confirmation of fault.

To be fair, DL were pretty good when I was looking for a UK DC2. And they were giving (almost) the best quote for me on a 172. But I don't think they like insuring Imports and modified cars, you have to call them for a quote on these I believe.
