Holiday Pay System vs. Time and a Half

But then what is the purpose of my 'holiday pay'?

I have no idea......without seeing a payslip or hearing their explanation all I can say is that you are being conned by the manager or franchisee.

Our staff are on a zero hour contract and we base their holiday pay on what they have worked over the last 12 weeks. Also when we were getting legal advice we were told our employees must get their holiday leave and not pay them instead of taking the time off. We were worried that some staff would not get use their holiday entitlement in a year so we payed them instead, due to legal advice either they take their due holidays by April 5th or they lose them.

That last part is poor advice......the employer is legally obliged to ensure all their staff take their statutory holiday entilement within the holiday year.....they cannot be paid in lieu and they certainly cannot lose them if they are not taken by 5th April......The employer has to ensure they have taken them.....this is why some HR depts end up scrambling about towards the end of the holiday year making sure everyone has taken their Statutory Entitlement, that is the point, it is Statutory, it cannot be removed or set aside.

I've always thought double-pay and a day in leiu for working a bank holiday is a bit of a con really. You're only gaining a single day's pay:cool:
