Insurance trying to con me

Fight the principle for sure. They either deliver you a 1 month old bike, or enough money to buy like for like. Seeing as nobody sells 1 month old bikes it'll have to be enough money to buy new. Try and get the scrap too and make some money out of this misfortune.

Go to the ombudsmen if you have to, judging by the phone calls (which will have been recorded) they'll side with you straight away. It sounds fairly obvious that they're being underhand to get you to take a lower offer.
 
I don't blame you! Make sure you get what you are owed. Maybe even make a complaint to the ombudsman that you were not made a fair offer in the first place / had to go through all this just to get what you should have been given?
 
I'm sort of guessing this was your first bike ? If it was you have been stupid on 2 counts, the first was only insuring TPFT and the second was no GAP insurance. Anyway, that still dosn't alter the fact that the third party insurers are obliged under law to restore you to the position you were in before the accident. Just out of interest, why and how is any "claims" company involved in this at all ?
 
doesn't matter if he's tpft if hes claiming off the other persons insurance though

yeah its risky if your at fault and you damage your bike

I called my insurance company to report the accident.
They put me through to the claims company to take the details and pass them on.
And I only have TPFT because if I'm at fault for a accident or damage my own bike, that's my issue and fully accept it (would only happen if I'm being stupid, but I'm a very careful rider) It's an extra £500+ for full comp for no reason which I can't justify.
Yes its my first bike.
 
If this is a an easy "blame" accident, then **ck the claims company off and deal with it yourself. Tell the third party you hold them 100% responsible and demand that they replace your bike "like for like". Part of the reason the claims company is giving you the run around is that your claim is so low, the only way they will make money out of it it to screw you for the other £400. Don't put up with it and deal with it yourself, you have to do this now because you didn't buy GAP insurance in the first place. Let this be a lesson.
 
If they cannot show 1 month old bikes (who sells a bike after 1 month??) at the value they offering you, then they have to pay out for you to get a new bike.

Stand firm.

There is no reason for GAP insurance if you are claiming off another persons insurance. They have to ensure you do not end up in a worse position than before.
