Issue returning clothing items

Most of the companies that sell in the UK aren't UK based businesses.

Apple for example is an American company based in Ireland. Can they ignore UK law now?

Anyone selling into a territory must abide by the laws of that territory.

Apple isn't a good example, they also have UK subsidiaries.
 
Did they charge VAT on the purchase? If so, would that not mean they are VAT registered in the UK and therefore covered under UK legislation?

Their website states:

"Europe: VAT (value added tax) is included in all prices"

So surely they must be VAT registered? If not, are they just sticking an extra 20% on the price and pocketing it?

It was charged to a company called via vegan Europe L London EC2A in sterling. I don't think they have a leg to stand on personally

(Mat and nat is a vegan leather co hence the name)

^^^ this is the important information. I initially thought it was cut and dried but quickly realized it was a tad more murky lol. But if they are vat registered and goods are shipped from UK/EU then they must abide by UK/EU consumer laws.

Its a bit of a quagmire looking at the whole sale/manufact process and checking which country's laws apply. e.g. Polyvinyl Chloride which is used in the bags Matt and Nat sell. Manufactured in China which has unbelievably lax regulation on PVC production in products....is a highly toxic substance.

When were the items delivered and when did you contact them asking for a return?

Not sure why OP is not answering this seen as it is one of the most important bits of information needed to work it if he should be entitled to a refund (due to a change in mind) or not.

This would be pretty useful to know!
 
Is it really worth all the hassle?

Just get your girlfriend to put the shoes on, take some photos and stick it on ebay. Some freak is bound to pay for them. I've seen some weird listings on eBay. Maybe you and your girlfriend can start a new business.

Oh yeah... that is also a side solution.

Just ebay them, if they still have tags on it's/new. You'll lose some money sure but you won't lose 400.

Well in that case if you can prove they were dispatched from the UK by a UK registered company then they don't have a leg to stand on. Were they sent from their UK warehouse?

Is this right, from what i have read:

A company that is based in Canada own a website that sells products to UK customers, to deliver these goods they open a "hub" in the UK with packers to ship the goods from the "hub" that's full of stock, they then can dodge UK selling\business regulations?

Sounds like a big loop hole that.

e: Bes, I know you seem to have solved your OP, but the above, can someone confirm that a company can get away with that.

Haha that's wasn't me but the ****s have granted a return following my threat of the county court.
