Both reversing and him back down a one way I'd say is his fault really, but both of you should have been paying more attention.

If the insurance would have taken it I bet it would have gone 50/50.

no because the highways act covers any private property to which the public have access.

Would be interesting if his works car park was securely gated and required a pass to enter / exit it however ! Because then technically the public would not have access and therefore not covered by the highways act.

Um it does, their is no access to the public to my works, its about a mile drive to the front gate from where this happened
 
if there is a physical barrier which only opens for authorised personnel and closes again then as far as i'm aware its not covered by the Road Traffic Act and is technically private property.

Not sure who you'd ask to confirm this to be true or not tbh.

Do you want to be a **** and turn round and refuse to pay him anything now you know you potentially don't have to ?

I am not sure the road not being covered under the Road Traffic Act absolves him of liability, instead only the requirements for insurance under the Act.

I think it's fairly safe to assume that you cannot damage other people's property through negligence and they have absolutely no means of recourse.

and to go anywhere with this presumably you'd need some kind of proof to establish blame. Comes back to the CCTV thing again i guess ..

which hasnt work on that car park since i sarted working their, due to sustain the future or weathering the storm because their a non safety/ process area

Unless the OP wants to go down the utterly ridiculous route of denying that he was in the car or the two cars made contact (he'll have to say this in court and commit perjury), then there was an accident. Both parties will blame each other and probably be partly blamed. They'll also have to pay the legal fees unless they have insurance to cover it.

You will have to lie about what happened to avoid paying something, and even then I don't think you'll get away with it. That's my genuine opinion of your chances rather than any ivory-tower view of it. If I thought you could do something I'd tell you what.
