Law on roadworks during early sunday morning clarification

Can vary from one council to another but generally 8am Monday to Saturday and 8:30/9 on Sundays. This does change for emergency works though which can be any time.
 
I wont be responding to any comments that are judging me unless that person states they have been in this position, judging people for something you have no personal experience off is disrespectful, thank you to the guys who answered me seriously.
 
General guidelines as I remember it for noisy street works is that it's permitted between :
Mon-Sat 0730-2300
Sunday 0930-2300

So 7am ish is a bit off for a Sunday morning.

This is my understanding as well but there are obvious exceptions for emergency works (collapsed sewers, gas main issue etc). I wouldn't expect routine resurfacing to fall under that though (it could be a consequence of an emergency repair though).

I think the Police's advice to take it up with the council is correct.

We dont even know what they were doing. I highly doubt its resurfacing work at that time in the morning so instead of actually asking them hes called the police :cry::cry::cry:.
 
You could try having a look at the environmental health -> noise section of the council website. There is usually a listed hours summary for council defaults of when building and construction works etc can be deemed fair game. Outside of those hours they can come out and enforce. I'd be surprised if road resurfacing at 7am on Sunday without prior warning is in line with council policy and you should be able to raise a complaint about it. It won't change it now but it does seem unreasonable. Problem is so many councils now outsource wholesale and have lost control of their subcontractors. I imagine you'll get a pithy fob-off half-apology and a "it wasn't our employee" side-step and "letters were sent out, not sure why you didn't get yours. no one else has complained la la la boo sucks to you", etc.
 
Surely a sane person would go out start a conversation and offer them a drink, you might get them doing some less noisy work first that way.
 
7 am is rather late in the morning - try having tractors ploughing fields round you at 5.00 am on Sunday - But as a townie my motto is "when in rome". Having roadworks is only a short term noise -Just be thankfull you don't have screaming kids and barking dogs day in day out.

not necessarily. I've had arguments with road workers even when I'm supposed to have authority over them. Some of them are ignorant obstinate <expletives> . I've seen working sequences ignored, safety ignored, no provision of temporary road crossings etc contrary to H&S and they just get arsey and sweary. Not all are bad, but I've seen enough first hand to know that it's a lottery. I recall being told to F'off when I pointed out to one team they hadn't provided any temporary crossings contrary to their agreed sequence and plan. How was this disabled chap (literally sat there in his wheelchair) supposed to cross a road to the station? Their response "not our problem. F'off". That ended up with the chap getting police who sent a fake one out with no real powers who in turn called the council. By the time council people returned to work the next day the worker had mysteriously vanished from the memory and no one could say who they were and the subcontractor said they couldn't recognise anyone of that description etc. Nothing happened, just a disabled guy got abused and discriminated against, and the company sailed into the night without any major consequences.

I think the police probably know better than you what is a waste of their time. Assuming he explained the situation, they decided to send someone over, who then decided to try and get the works shut down actually suggests they thought it was a legitimate complaint and the workers were doing something they shouldn't be. /devils advocate

Unfortunately OP, you won't get any sympathy on these forums which seem to take no notice of how to be decent neighbours/human beings and run the "I'll do what I want and **** you if you don't like it" attitude. Just be thankful it's hopefully a one off.
 
I have also lived next to 3-lane major roads where they would do resurfacing from a 10.30pm road closure through the night (Zone 1 london) and next to various railways/tube lines where NR/TFL would do works solidly over a weekend including over night. Sometimes that is the best way overall, even if it is miserable for people living around it. All you can do is ear-plug up and make the best of it. The good thing is doing it that way is short and intense but then it's done. Better that than several weekends on the trot with all the set-up, pack-up clattering and still the disruptive noise. It could well be the council did an assessment of duration required, and just said get it done. They should have notified though if it's not something with a long-standing maintenance order etc.
