MegaUpload has been shut down

I'm pretty sure messing with DRM is illegal. Back in the PSX days, when everyone had a chipped grey playstation, everyone said it was legal to have the chip, but illegal to have the games. I think thats still the case now. Regardless of owning the original copy!
 
Its against the terms of the EULA.

I bet the developers are missing out on more revenue through pre-owned games than pirated ones.

They can put anything they want in the EULA, it doesn't trump law.

As for pre-owned you could say the same about anything being sold second hand but most other industries aren't lobbying to ban pre-owned, how much money are Asus etc losing thanks to OCUK's MM?

Well the wording of the software EULA is winning court cases in the US. Most other industries are not sold as a user license, you buy and then own the item.

Asus will be losing very little compared to developers and preowned games.
 
Of course they are losing out, why do you think EA etc are trying to kill off the pre-owned market with download codes?

The scale they may be losing out due to pre-owned is dwarfed by the impact piracy has.

Pre-owned shouldn't really be that much of an issue for them, they should see it as an opportunity to create a better value proposition for the end user.

"You agree not to: (a) Commercially exploit the software; (b) Distribute, lease, sell, rent or otherwise transfer the software, or any copies of the software, without the express consent of the licensor."
 
In the case of preowned console games, they are using codes that let you activate certain parts of the game only once. Online play in FIFA 12 is an example of this, you need to use the code that came with the game or pay £9~ for another one.

In other ways, they are using digital copies instead of physical ones.

Further to that, they are trying to get the law changed in regards to having pre-owned games sold right next to brand new copies.

You will notice that this practise is outlawed with Music and Films, which is why you don't see pre-owned copies sat right next to brand new ones in HMV. They want Games to be brought into line with Music and Films.

Difficult to say really given that even getting an accurate figure for genuine loses from illegal downloads. Never mind trying to get a figure for the cost of pre-owned games on new game sales.

If they don't want to stop pre-owned then why are they moving to mostly online content that requires a key?

Finally, seriously this is what publishers should have been concentrating on for years.

It's rather absurd that a market as huge and constantly expanding as games should be treated differently at this stage, especially regarding pre owned, I mean what do you expect someone to do when presented with 2 perfectly functioning copies of the same product, one brand new and the other "as new" and to all intensive purposes perfect, the former marked at £40 and the latter £15.

On the flip side of that coin though, I guarantee you that the prices won't go down if preowned is banned, more the opposite I would suspect. (Look at the online pass pricing, and the trend towards DLC)

The whole market is flawed in terms of digital distribution sadly, and there is no easy answer.

It's not necessarily going to mean sales of second hand are completely banned, they just won't be able to have new and preowned on the same shelf, with bias due to better pricing on the preowned.

Japan, China and Korea have said NO to the FBI, and that even if laws are passed in the USA, they will not have any value within the sovereignty of their countries
