Either as a witness to give evidence, or purely in a spectator capacity? They were (along with Ferrari) the ones who lodged the complaint afterall.

Not looking good for Merc. after the FIA put their case forward, will be interesting to hear Mercs. defence.
 
Going by what CW is saying, then its going to end up being that Merc lied about it being public knowledge, or the FIA lied in their statement about CW saying that Merc had to tell everyone about the test.

That's an interesting one. Article 2.1 of sporting regs says: "All drivers, competitors and officials participating in the championship undertake, on behalf of themselves, their employees, agents and suppliers to observe all provisions of International Sporting Code, the F1 Technical Regulations & Sporting Regulations"

Mercedes said it regretted and apologised for the decision to have race drivers Lewis Hamilton and Nico Rosberg war plain black helmets at the test.

"We had our reasons," said Harris. "It was about the lack of bodyguard and security personnel. We do acknowledge that this part of the test aroused suspicions and it is regrettable."

But it's the truth. I can see Pirelli getting a fine and then leaving F1 and then suing the FIA
Which would leave the door open for Hankook to come in next season where it all starts again.

On a side note I emailed the BBC asking why they broadcast all F1 races live to other places other then the UK.
Nothing back as yet and I don't think I will :(

They had to come up with some reason.
They either say, "We didnt want other teams to find out that we were using the 2013 car, along with the 2013 drivers, to get additional testing miles on a car which shredded its tyres at an unprecedented rate."

OR they make up a story, and use "security" as the reason for using unmarked helmets.

Merc knew exactly what they were doing and decided to go ahead with the test anyway - remember, this test was on the day after the Spanish GP - a GP where they qualified in pole and went backwards at an astonishing rate.

He is completed perplexed on why the car is shredding the tyres. Hamilton had no idea either. Neither did the team.

Merc desperately needed additional test data. Any data would've helped them.

Brawn is a smart guy - more than you or I - and to suggest that he'd be foolish enough not to know the in-season testing rules with the current car, is nonsensical.
