Has that racist bus rant woman been in court yet? Whilst I have no sympathy for this guy and would happily have seen him given longer, she should definitely get longer!

The motivation could have come out in the subsequent police interview, it doesn't need to be in the tweet.

rampant use of the N word, the W word, laughing about the N being dead, going on and on and on about Ns Ws and all sorts of other pretty vile abuse.

Will that do you? Seriously, google his name and you'll find the full transcript. It's got very little to do with Muamba being black, I'm sure this scummy individual is a habitual racist.

And I don't think Muamba is the victim per se, we all are. If he's been done under section 5 then it's basically anything that's likely to cause harrassment, alarm or distress. To anyone.

Can I point out that the appellant was not convicted of a racially aggravated s5 public order offence, it was in fact a s4a public order offence.

I'm pretty sure you cannot receive a custodial sentence for racially aggravated s5.

The guy sounds like an absolute dick but prison was way OTT if it is just for the tweets. If he has previous eg. links to racist groups, racist threats/attacks etc then fine send him down. I recon he is just an attention whore who was trying to be controversial by tweeting some racist crap. I'm sure the black guys he meets inside will let him know what they think of it all anyway.

There was a lot more to it than that one tweet....there was around 8 or so tweets that were vastly more offensive and were specifically racist in intent....however they were not inciting, only offensive.

It does appear that he should notmhave pleaded guilty hoping for some degree of lienency, it would appear the original suggestion on these forums, that he should have guilty plea against a communications order rather than against the charge of racism, or fought the charge of racism on th grounds he said racist things but isn't a racist.

As his plea was guilty the judge shot him with a slaughter cannon on any appeal.


People get much less for doing much more.
This doesn't seem balanced to me in any way.

It was me that made those suggestions and now that I've read his comments via the full transcript he would've been convicted after trial anyway and ended up getting longer for not pleading guilty in the first place. (You get credit for pleading guilty before trial and is taken into account by courts but not enough to escape custody in this case).

The alternative plea to malicious communications woould also end in guilty and has same sentence powers. So he was
