New Flat - Parking Issue

i dont see the problem, if your parking ticket fell off in a public car park youd have the same issue.

the parking warden isnt going to know whos are the residents cars are parked "legally".
 
In a public car park I don't have another contract stating my right to park there.

do you though? i suspect your contract says something about having the use of X parking spaces, but you still have to abide by the signposted rules of the carpark. the estate agent typically wont have any control over what the management company of the flat (and subsequently any parking enforcement company) does.

It does say I have the right to use it.

I have now been removed off the list of spaces to be monitored, so my point is that I was never asked to be on the list. Enforcement only started in February and without my consent. Does that not mean anything?

Don't pay and if required take your day in court it shouldn't stand.

not really. ive lived in several flats and its never been written into any contract that you'd be exempt from any tickets and always had to abide by the rules of the carpark. dont think its unreasonable if youre not displaying your permit for whatever reason.

Does that apply if the enforcement came into play after the landlord bought the property and let it out?

Can they just start applying enforcement when they feel like it without consulting everyone?

i found usually they only really cared what the flat owners thought and sent them any notifications of changes etc, but whether that then got passed on to letting agents/tennants..

still dont think its unreasonable. you had permits so mustve known you had to display them or get fined. like i say ive never known a tennancy agreement overule any parking enforcement.

anyway, i dont think you'll agree with me so ill leave it there :)

I disagree.. I had an issue in a pay and display car park, the adhesive failed for whatever reason and I returned to the car to find the ticket in the footwell and a speculative invoice stuck to my screen.
I appealed on the grounds that I was entitled to park there, and included the proof and the speculative invoice was waived.

Don't see how permit parking is any different in this respect, if you can prove your entitlement to park I'd simply tell them to see you in court.
 
RMG. what a company.

had a fair few run ins with them due to a property i owned. they are robbing bar stewards.

paid them for 6 years of owning yet any issue i raised (they didnt cover) and then to top it all off when i moved out they wanted £360 for a "sellers pack" a few bits of paper which i had no choice but to pay.
 
I have already appealed to UKPC with my reasons, and stated to them that if they don't agree to send me a POPLA code. Also stated that I am happy to see them in court.

I'd leave it at that, unless you get your code or a summons (very* unlikely) the ball is in thier court.

What's more likely is they will send further ransome letters in the hope you will buckle.
There seems no point in further communication as you've clearly stated your position.
 
Had a 10 year fight with my management company leasecare based in Kendal over parking my works van in my own paid spot with the issue of commercial vehicles not allowed lol, brings down the area with having a van they say:eek:

These companies really are vultures, you could maybe understand if it's very limited parking, say 5 small bays for 5 residencies, and your parking a 7.5 ton rigid..

You will find that covenants preventing the parking of commercial vehicles are actually fairly common. Ours locally extend to caravans and motor-homes, too.

Yeah it just bans anything commercial which is unfair, i could understand people bringing coaches or wagons home with them, but small company vans is a joke, company cars are allowed but no vans:(
