Not happy at all with GEIL

At least its a good outcome, im sure the £6.07 is a small hurdle. I know getting pc6400 series ram is getting a lot harder to get as I tried to get them another stick not long back.
 
AFAIK, that's wrong. Up to 6 years under Sale of Goods Act, up to 2 years under EU law.

Retailers fob people off with this tosh so it's not surprising people believe it.

That is correct. You have up to 6 years to seek redress from the date you buy a product (under sale of good act and enforced by the statute of limitations). The retailers often quote a warranty of 1 year with them and then the remainder with the manufacturer. Some even quote 30 days and contact the manufacturer after that. This is referred to as an optional guarantee and has no impact on your consumer rights which hold the retailer responsible for redress for up to 6 years. You are under no obligation to deal with the manufacturer (though you may choose to do so). If the retailer can't offer a replacement or repair, then a refund is required. If a repair is offered, then the repair of that particular issue has to be permanent or you are entitled to seek replacement or a refund.

Your best bet is to spend the 15 quid or whatever it is in the UK and bring the retailer to the Small Claims Court and wait for the courts registrar to contact you. Before you do this though I always advise people to send the retailer a letter outlining your disatisfaction with what they have offered, and they have 20 days to remedy the situation or you are initiating small claims court proceedings. You don't need a solicitor and the retailer cannot counter sue you. Consumer affairs and Trading standards will advise you the same.

When it arrives in court it's up to the judge to determine if the product is fit for purpose and he/she will take into account wear and tear and will decide on how long the product is meant to last and what financial redress is appropriate. For example if it was a washing machine you can expect it to last more then 3 years. But maybe not a mobile phone.

As regards the EU Directive which allows for 2 years cover with various stipulations, this directive was(Directive 1999/44/EC ) not 100% enacted into Law in Ireland and the UK due to our current consumer laws offering better protection by default.

Just out of interest you had it for 3 years why didnt you send it straight back to geil?

Also If I did what you did I would expect what the current RRP is of the ram as I wouldnt expect what I paid for it back especially if its 3 years old.
 
I know this has been dead for a couple of weeks but I thought i'd point out that when my Viewsonic VX922 monitor died (damn you low quality capacitors!) just before the 3 years warranty was up, I was given a full refund as the model had been discontinued.
Although in this case it was ram I don't see why he should have been given anything less than a full refund if the line had been discontinued or no like for like replacement was available.


I'll point out though that I had some hassle getting the warranty honered as Viewsonic changed the warranty on the model to 1 year (a year or 2 after i bought it) and the retailer i got it from said they were going by that....Absolutely dodgey as hell and illegal as i pointed out.

Geil actually sent me a replacement set which only took 4 days to get to me after receiving the dead ones from me.

Though I have noticed the voltage is slighter lower than the other set I have 1 set is 2.1v the new ones are only 2v. I've put them back in the system and left the volts on auto.

So were you happy with the Geil RMA service in the end?

Warranty is a warranty. They want you to forget it after 3 years they shouldn't offer it. Retailer doesn't like it they shouldn't stock it.

I would play merry hell with Geil and point them to this thread. Last thing they want is bad publicity because one of their retailers is trying to do you over.

Dont expect 160 but expect like for like.
