Being caught using a phone needs to be given incredibly harsh punishments = car crushed + licensed revoked levels of punishment.
Causing an accident like this may as well be on the same level as murder with intent. The moment you pick that phone up and look at the screen you made a conscious decision to turn your vehicle into a weapon that you are not in control of.

That would be classed as an accident, if you genuinely had no intention to kill, and fire 1 bullet in a legal area - Hunting accident etc.
