Would it be possible to start a pub that is classed as private, so people can still smoke in it and also need no set trading times? So there is no signs etc you just hear about it from word of mouth. And to get in you have to knock and be welcomed in by the home owner shake hands so it's like a pub of 'friends'. Sort of like a lock in? Or is it all completely illegal?
 
I believe this came up before and the problem is that if it is a place of work you cannot smoke there... Someone did suggest getting special contracts for employees drawn up to say they will work in a smoking environment, but if you're serious :rolleyes: I would ask the authorities.

Well sort of but the owner is 'friends' with the beer drinkers, making it a bit like a party.

Any extra workers would be friends etc so they wouldn't strictly be employed by you. They just did the favour of manning the pumps for a while and got money as a reward. And you would mainly be the barman.
 
Are you going to charge for the alcohol? If you are then you've got a problem in that it becomes a place of business and then it must fall foul of being a place of work (with or without any employees other than yourself). If you're not going to charge for alcohol at any time then I'm heading down to Bournemouth, the first round (and every subsequent one) is on you.

Also I very much doubt that you could choose to derogate out of the non-smoking legislation through use of contracts for workers, it would defeat the point of the legislation if you could.

But if I have a few beers in my fridge and my mate wants them to save a trip to the shops I will sell them to him. Is that theoretically illegal if he where to be smoking while all this was happening? Also could you give the beer for 'free' and they give a 'donation' to me?
 
Why don't you just invite all your mates around to your place, and smoke while you drink?

Like regular people do...
 
I've been to a few private clubs as a guest. People smoke, no money changes hands for drinks. It's all done on a membership basis.

I'd hate to think what it would cost, and it's invite only.

Setting something up like this would take a silly amount of investment, as you'd need a special location, a good contact list. Basically If your not in the crowd already.... It's going to be tough.

Ahh i see, membership basis. So i would just charge money to the membership account for the privilege to have a drink in my building. Might set one of those up one day :)

I imagine if it was that easy everyone would be doing it and we'd all be "private memebers" of one bar or another.

Sell something trivial like a cheap sticker or pen for £2.50 and give them a free beer?

raffle tickets are a good one, mark the ticket when it's been used for a drink, have a raffle at the end of the night. This has long been a fairly accepted way of avoiding needing a licence.
