Smashed A Window @ Footy, Where do I stand!

It's there fault for not taking measures that accidents like this can't happen. Don't pay mate it's not you fault the window should either have not been there, been made of toughened glass or the fence should have been higher.

It's a football pitch and they should have put more thought into securing it.
 
Of course, I would imagine that everyone here who is saying there should be no need to pay would also support the sports centre in denying use of their facilities to the thread starter and his friends in the future?

That would also be protecting their investment.

Wait, why does he have to pay the excess, surely they have an excess so they have to pay should the need to claim arise otherwise they wouldnt have an excess?

I wouldn't pay, they should claim it on the insurance, and those going on about high insurance premiums, the center should cancel their policy if its too high and get the people who rent the pitch to pay for damages by a contract.

A very bad business move I would say. If they want to avoid such a mishap in future, they should protect their windows with mesh.

Accidents happen and they should not always be paid for.

Why should he be penalised at all? what as he done wrong?

He broke a window by accident because the centre had not taken precautions against things like this happening and then had the decency to report it.

He's done nothing wrong imo and the sports centre should sort this out so it doesn't happen again.

I support the sports center to do whatever the damn well they please, after all they dont have to serve anybody.

Yes but you probably don't charge people to come and play football outside your house. And if you did then it would be as in this case your fault your window got broken for not taking measures to ensure stray balls didn't come through your window.

Totally agree with you, Gilly et al. There isn't in ice cube's chance that I would pay.

8ft is no way high enough for football, We have a pitch near us with 20ft fencing which is much more practicle.
 
What size is the pitch? You said astroturf? so 5 a side size? If so, 8 ft is more than adequate.

Just sounds like you were messing about, and went too far. You broke the window , you and your mates responsibility I would say.

yes and no - there are a couple of types of trespass e.g. if I patted you on the bum it would be trespass to the person, but I've not 'entered' you <shivers>


@pumaz - they did take measures though - they built a fence - you can always say 'build a better fence', but how good does the fence then have to be? 20ft, 50ft, 100ft?

must have been cramped with 16 playes on a 5 side pitch , and 8ft is not adequate ...your telling my you never spooned a shot?
 
You shouldn't have to pay - The reason you pay £18 an hour should cover problems like this. If they haven't priced insurance into the charge then more fool them.

They are just trying it on to make you pay so they don't have to claim.
 
its a full size 11 aside pitch and we rent half the pitch for an hour!!!

Im not paying it full stop! i never accepted responsibility I just made them aware that a window had been broken.

Also his comment was that unfortunately the window was broken during our booking time therefore we have to pay a charge..

Does that mean if someone had been murdered on the pitch during our booking that we would have been charged?!?!

He doesnt have a leg to stand on and he is a complete **** anyway!

And it is a lottery funded sports hall!

8ft is not adequate, we've got I guess 16ft nets down at our local Goals 5-a-side and you can pretty much guarantee that at least once a match someone will sky a shot over it.
