I haven't worked since they let go of contractors end of 2019. Best thing that happened to me :) Get to enjoy my kids while they're still young. Spent too much time travelling and working, it's nice to just relax and focus on family, and on myself :)
 
We have to do a QDOS assessment every ~6 months but they keep deeming us outside so continuing as normal.

Similar here. Rates took a nose dive with the oil price 2 years ago and I ended up out of work for 3 months when the project I was working on finished.

Market here is beginning to warm up, I've never seen so many "x has started a new position" posts on linkedin in the last few months. The Ukraine war has also put a new focus on domesitc energy security. 6 months ago investment in UK O&G was toxic with the Scottish government but they are now largely quiet on that subject.

A lot of people have left the industry after the way they've been treated by the industry itself and also the government over IR35.

So ... the organization tasked with finding tax dodging scumbag contractors is offering an outside IR35 contract ..... wtf ??? Its a trap surely :D

No its legit. My mate was contracting with HMRC for almost 2 years, outside IR35 during when they were changing up the rules a few years ago lol

Weirdly I got an email today about a PM position in Portsmouth, I didn't even know what IR35 was until just now, it said IR35 inside. Not taking it anyway, not that short sighted plus there was no guarantee I'd even get it.

Now now, us scumbag contractors were and still are legit, it's all those cheeky disguised employees that IR35 is meant to deal with. :D

In I think 2018 I worked for about 6 months as an LTD contractor, as advised by recruiter/accountant/everyone I consulted about it, but turned perm after 6 months as I was made a very good offer. The money was better as contract, but I was happy to have the security of perm, and also that was a time of big furore over IR35 so I wasn't sorry to wind up my LTD and move on.

Have just yesterday had an interview for a contract role (having been perm since) and it's advertised as IR35. As expected, the recruiter says it's all dandy and because the employer is classing it's outside IR35, I have not a thing to worry about.

From what I can tell, the landscape has 'softened' a bit with regards to how contractors are viewed, though I hear now a substitution clause is apparently the silver bullet that is able to classify you as a bona fide contractor (!) rather than disguised employee.

When I queried with the recruiter if the contract wording for outside IR35 contracts is now well established between their agency and contractor's LTDs, as well as between the employer and agency, he didn't even know. And he's supposed to be a fairly senior guy in quite a major agency.

I was hoping when I saw that this role was outside IR35, that at the very least things would be a lot clearer now than they were 4 years ago, but it really doesn't seem it. Or is anyone here able to help with a bit of clarity? Will HMRC be largely uninterested if the employer is gladly classing it as outside? Does the fact the employer is the one making the determination mean there's little (or no?) potential of blowback on myself?
 
Ultimately the risk now is bourne tax wise with the client if it goes pear shaped, but you should still get your contacts and working practice assessed by somebody competent in IR35 to show due diligence.

The client should be questioning you as well as part of their due diligence, as you also need to demonstrate to them you are operating a legitimate business. If they’re not doing that then they’re likely paying lip service to IR35.

That’s their issue though you could (unlikely as it is) get sucked into an investigation and have to deal with HMRC and also having the contract changed or forced to go PAYE with a loss income to yourself afterwards.

But I wouldn't be surprised if the hiring company opted for "outside" just to try and make the role attractive to as many people as possible, and many will just dive in with no regard to the consequences.

The huge amount of uncertainty is a real shame as it must really be clogging up the contracting space.

The company hiring you are taking the risk in this example :) you would still have to pay the tax if it was obviously inside IR35 and you got caught but should they would have to pay the big bucks
