Lol @ people basing their views on short news articles...


How much more is needed beyond, "she doesn't remember what happened" and "guy gets 5 years in jail for rape".

She does not know she was raped, at all, there is and NEVER will be science to dictate when someone is or isn't capable of giving consent while drunk as you can't measure or decide what someone else would have done in a different situation.

She might have said no, but she doesn't remember doing so. Two guys had sex with a girl who went back to a hotel room with them, there is no proof of rape of any kind.
 
Not going to comment on the specifics of the case, but while I am sure that famous sportsmen do rape people, I am always a little dubious. Apart from anything else they can even pull women due to their fame, or just pay for sex with their huge wad. OK so Ched Evans isn't a Premiership player anymore so maybe doesn't get recognised much, but still.

Actually I lied when I said I wasn't going to comment on the case, I'm a bit sceptical when it comes to multiple sportsmen having sex with one girl, because it isn't just one bloke who decides to take things too far, it's both of them. I mean lets say you are out with a mate and you bring some drunk bird back to the hotel, she then passes out or whatever and your mate says "quick get her knickers off, I'm hopping on", I'd like to think that most of us would step in.
 
To pick out one thing from that - she didn't go back to the room with both of them, in point of fact. So, you can't even grasp the simple facts laid out in a short BBC News article. If what you said is all that's needed, why did the trial take longer than five minutes?

Consent, in criminal law, is also a very complicated area. Have you looked into the case law around it? Have you even looked at the Sexual Offences Act (which I linked to)?

Oh, your argument is pedantry, yup, I'm honestly going to believe you.

I've said more than once that Evans was called, yet again with too many people on this forum, shortening a statement for the sake of not writing an essay gets you into trouble with the pedants, and writing too much gets you in trouble with everyone else.... boo hoo.

As for consent, who said it was easy? did anyone? In fact didn't we all say it was basically impossible to establish. Again I'll point you to the arguments in the thread, if it were an obviously mentally handicapped women they met on the street and took back to a hotel.... that is fairly straight forward. Deciding based on a women who got black out drunk if she was capable of giving consent IS impossible.

The guy who spent more time with her, saw her stumbling around drunk(supposedly) and supposedly slurring her words.... is the guy who got off, the guy who saw her already in the room, likely already on the bed, with far less chance to see her acting "out of it" is the guy who did get done.

The same, the problem here is, she can't remember anything, they clearly didn't come out and say "yeah, she was like totally unconcious, we raped her", so there isn't anything to indicate she was unconcious, out of it, or responding like a slightly drunk person would.

If a similar situation happened and you could prove her state of mind, the video, or one guy deciding to turn himself in, etc, you'd have a case, here its a complete guess. Realistically the question is, reasonable doubt, you can't go sending someone to jail for 5 years when there is basically no evidence, no witness, and no possibility of determining how capable she was.

I've seen people seem almost completely with it, but the next day they can't remember a thing that happened, and likewise I've been completely unable to remember evenings, and on different occassions I've been, almost incapable of standing up, or completely able to hold down a conversation. Without someone coming forward to say in that room, at the time Evans arrived, she was utterly out of it, its a guess nothing more or less.

It would likely have been some time after she left the club and probably stopped drinking, and she was eating, she could even have been pretty out of it in the cab, and completely with it an hour later.

Such a stupid situation, he's 23 and had an amazing season and he's thrown it all away. What an idiot. I like how people are making conclusions without seeing all the evidence too.
 
I know Ched through school and I also know his sister. I'm not defending any actions in anyway as I do not know all of the facts, like everyone else here. The, however, girl has a reputation for being a bit of a wild child and has also cried wolf before and what isn't in the papers is how she remembers buying a pizza, talking to random people waiting for a taxi, being able to count out the change for her pizza and also how many drinks she had that night.

So before you jump to conclusions remember that the general public won't know every little detail of the case and as he's a fairly successful footballer it can be seen as a media conviction.

It's all very strange really.

United have got to move on, and hopefully there is more of a plan than to put Beattie where Evans was. From what my dad has said, that's pretty much all that happened. I'd like to see Hoskins get some game time now, he should do well really. Very, very nervous now though, I wasn't before.

I wondered what was happening with him! Didn't he take an extended break from football due to depression or something? Or am I thinking of a different David? :o
 
No? Might be thinking of someone else, he was injured badly and released, then River picked him up :cool:

I've just read in the Times that Yaya Toure won't be punished for giving the Wolves fans the finger at the weekend. I'd love to know how the FA decide on some of their punishments.

Can't say I'm surprised. I pay such little attention to practically everything, it's shocking I make it to work and back without getting lost, never mind anything else. :p

I'm pretty similar, I pay attention quite a bit to one or two things and everything else becomes background noise.
 
News from Italy.

Ultra's decide that the players aren't fit to wear the shirts... so naturally go mental and force them to take them off.

Kudos to Marco Rossi, man has balls to go and talk to the fans when they're like that.

Also; manager has now being sacked from Genoa but they're probably still going to be relegated because they're **** so far this season.

A warrant was issued for the arrest of Pienaar yesterday because of unpaid speeding tickets.

He made some funny tweets last night including one that said he was off to Amsterdam. He quickly deleted them though. :D

Looks like they've sent them to his old address, which I'm guessing is in London, since he's now playing at the other end of the country near enough. So instead of actually doing some research or contacting the club or his agent the Police have just gone straight to the media to try and shame him. :D
