No, I think you've misread as that doesn't follow.
The first tweet talks about visibility - i.e. the priority of stuff re: appearing on the timeline as dictate by the algo.
The second tweet is talking about not being suspended for it.
Those are different things, there's nothing to show anything selective about the application there i.e. if you misgender someone in a tweet deliberately you take a hit in the algo for that tweet but you won't be suspended for it.
Edit - separate to that whether some accounts will have some additional protection because they're Elon's favorites is obvs an open question and quite possibly the case, likewise he wants to be seen as pro-free speech so has reversed the bans of some leftist accounts that were prominent and generated some visible complaints/appeals to him.
