Actually I think you will find the guy has more rights here.

Regardless of whether it is the OPs phone, its been secretly filmed on his private property and clearly shows his person. While if this is the thief, I think he deserves what he gets, I'm sure that you will find legally that the supposed thief has the high ground here.
