My opinion is that people should not be judged just because they go beyond there limit. It seems yourself and L0rdmike from the tone of your posts are doing just that.

This thread is about people who moan when they get charged for going overdrawn. If you chose to read more into it than that, then its frankly your problem not mine.

I went beyond my overdraft and also used a credit card to pay for my legal fees. Thats clear yes ?

Im not miffed that I got charged for that but I am claiming it back because I can.

You're right - they are a business. But they operate in a heavily regulated industry. Loaning money to someone at an effective rate of thousands of percent APR is one of those things that needs to be regulated.

What should happen is that you should be charged for going over by an amount that is a proportion of the amount you went over by - go over a lot, get charged a lot. Go over by a little, get charged a little. Plus perhaps a small admin fee.

Fox / Dolph let me ask you this..

If the government decided (saw sense) that they were charging people too much for road tax and it just so happened that the car you drive was illegible for cheaper tax and a rebate. Would you claim ?

Of course I'd claim it back.

My opinion is not that people shouldnt claim if they are entitled to but that the system should exist as it does now and the charges are not 'unfair'.

Of course I have but I would be a fool not to get the charges back given the opportunity.

As yet you haven't been given the opportunity, you've just threatened the bank who have decieded it's easier to give you money than argue... That would normally be called extortion.

So what would allowing peope to exceed their overdraft past their agreed limit, and then charging them massive fines that don't reflect the costs to the bank be called?

I think this thread is about the legality of charging someone a grossly disproportionate penalty fee. Turns out it's not, and everyone should get their money back.
